Yeah from the police on up to judges and jury's there is an enormous amount of opinion going in to the entire process... among other things.And to me that's a fundamental problem. Maybe some wiggle room in sentencing but when I say wiggle room I mean 15-20%. Not one dude gets a 26-year sentence and the other gets treatment program. (and these guys both had long records). Give people treatment if they need it in prison not instead of it, and give em a chance with more treatment when their sentence is up.
It's a huge game for most of these people, and even your "defense" may not really be on your side. The defense attorneys spend their career working across the aisle from the same set of prosecutors and judges, and they have multiple cases they are arguing behind the scenes for deals on. Imagine how that can go... you are just one of the many cards on the table and any "deal" that might be made on your behalf is not treated in isolation, it is weighed against the other deals/favors/whatever all the people involved have made recently. Good luck to you if your lawyer has recently pissed off a judge or prosecutors.
The end result is a massive variation on how individuals have been treated.
(I still think attacking a judge is a specific circumstance that should add a penalty, but certainly not a massive one)
