Darin Wilson will be allowed to testify to a grand jury BEFORE charges are brought. What a fucking load of shit.

The purpose of the grand jury is to indict or not. If he is indicted, he is then charged.

Why wouldn't the grand jury compel him to testify? And why would someone see this is a bad thing? They're conducting an investigation.

As long as the 4 eye witnesses are afforded the same courtesy. Just seems weird that this guy is going to get to sob on a stand and defend himself before possibly having to defend himself.

Grand jury decides if there is enough evidence to go ahead with a trial/issue criminal charges. I'm guessing his account falls into the evidence pile as will others.

Because it feels like passing the buck a bit. I don't know if it's part of the union contract or if it's normal, but as someone who isn't sure it feels like they're just trying to shift the responsibility. Instead of charging him right away, they're putting the burden on the grand jury. So if the grand jury decides not to indict, they get most of the fallout. Again, this is from my uninformed perspective.

Cranky, I like you, but I don't think you understand how a Grand Jury works.

The grand jury can subpoena witnesses to testify.
He will be testifying to what he saw during the shooting, not defending himself.

He can't be compelled to testify to the grand jury. Fifth Amendment and all. I'm not a criminal lawyer but I've never heard of the accused testifying before a grand jury. There'd be no advantage. The grand jury process involves only the prosecution putting on its case.
 
true, but all too often people like to not find a clear right and wrong in favor of just saying "well both sides are wrong". and im growing increasingly tired of that respobse when it comes to a whole host of issues. while i agree that we need to be patient with this current case in Ferguson, i sonehow get the feeling it'll inevitably lead to "well both sides are wrong". and im not sure if im ready for that bullshit just yet lol.

Well in most instances 'both sides are wrong' is usually true.

It is perfectly possible for this shooting to justifiable under the current standards while also seriously questioning those standards.

The drug war and the resultant militarization of police is a serious problem in this country, but I'm not willing to put all that heat on one officer if he acted with reasonable fear for his life. That is a systematic societal failure, not the crime of one man.

I'll chime in since I don't want him speaking for me either. I agree with everything he said, but although their rage is justified, I don't believe their actions are (burning down that guys business).

I don't think I agree with that because I don't ever want to find myself at the end of a sword because somebody is mad at something that has nothing to do with me or my life.
 
I really don't have anything else to add. I don't agree with it. And he can speak for himself.

I think he gives the accurate and truthful diagnosis of US society and the discrimination/marginalization of Black people. And I think many, many people either aren't aware of this accurate diagnosis or don't want to face the hurtful truth because of various reasons.

The fact that many people in the US still don't get the root causes of why oppressed people react the way they do is so, so, so tragic.
 
A grand jury looks at evidence and determines of there is enough to take it to trial.

Then a trial jury sits on the actual trial and comes up with the final verdict.

Having the accused able to testify at this point may color the opinions of the Grand Jury on the possibility of conviction, and therefore may result in charges being dropped (or being brought) that would not otherwise have happened from the (supposedly unbiased) evidence.

Am I understanding that correctly?
