FYI:
This is the story @ShaunKing was referencing about shooting from behind:

However, law enforcement officials say witnesses and forensic analysis have shown that Officer Wilson did sustain an injury during the struggle in the car.
As Officer Wilson got out of his car, the men were running away. The officer fired his weapon but did not hit anyone, according to law enforcement officials.
Those 2 paragraphs seem to be referencing a law enforcement source.
..but the article really does highlight that there has been quite a few discrepancies about what's been reported as far as witness accounts.
What does seem to match up between all accounts so far, both from whoever that Josie lady is and the eyewitnesses is the following:
- Johnson and Brown are stopped in the middle of the street.
- An altercation happens at the vehicle.
- Brown runs down the street fleeing from the vehicle and Wilson.
- Wilson gets out of vehicle and goes towards the fleeing Brown.
- Brown at some point stops, puts his hands up (how high is in dispute) and turns towards Wilson.
The details besides the above conflict between everything I've read. Johnson says Wilson pulled Brown into the vehicle through the window. We haven't heard anything clear from anyone about what exactly happened in the vehicle. We have conflicting reports of what happened when Brown turned around: ranging from stopping with hands up to stumbling towards Wilson and lastly to charging Wilson.
The entire case hinges though not on what occurred in the vehicle, IMHO. It hinges solely on what Brown did when he turned around. The struggle in the vehicle does matter to put into perspective both parties mindsets to the last moment, but really that last moment is what will decide it.
If Brown turned and stopped it's murder, plain and simple. If Brown turned then went towards Wilson then he'll walk.
