The Patriots make a strong case in their rebuttal.
It's definitely true that the the false statements about the measurements stood for so long that the Patriots were never given a chance in public opinion. Early on we were told the Patriots had a ball measured at 10.1 and all the Colts were in the legal range. This completely formed public opinion that they were obviously guilty, we heard nothing but jokes about flat balls.
Only later do we find that, using the logo gauge (the one the official thought he used), the Patriots average 11.49 at halftime, exactly what you would expect scientifically if they measured 12.5 on that gauge to start the game. And that the Colts only had 4 balls tested, and 3 of the 4 tested under the minimum by at least one gauge. Proving not only that the evidence is weak to support the Patriots deflating the balls, but that even if they did it would only have been by a tiny amount.
The entire controversy, once you realize the early reports were false, is over whether or not they let a tiny amount of air out, when other teams have manipulated the pressure with sideline heaters and been let off with a warning, or applied banned adhesive substances and got basically no punishment. It's absurd.
And that's before even getting to the NFL's procedure. They use multiple gauges which average .38 difference, and they don't keep track of which they are using, nor do they write down the measurements. They switch gauges seemingly at random. And when they think a ball is under-inflated using this imprecise procedure, they inflate it themselves, sometimes well over their own legal limit! It could not be more clear that they didn't care about getting the pressure within their stated limits.
Meanwhile, despite the free, humorous language used in the texts, there was still not a single one that said Brady wanted balls deflated under the legal limit.
