I don't normally agree with you on most subjects, but this is just getting out of hand.

Disappointing but unsurprising. No way would it stick because big names like Brady draw viewership and game attendance. Everyone eventually bends their knees to the almighty rating and the power it holds over advertising dollars and ticket sales.
 
Cheated his way through this again. The NFL needs to find out if the judge is a patriots fan and if he is the ruling should be nullified for conflict of interest.

Yeah, this will definitely get appealed by the NFL.

The judge's logic here is basically that the NFL has to define punishment for any possible rules violation and someone is entitled to get off scot-free if they don't.

That's one reason. And it's a great one. But he also gave two other huge reasons for overturning.

The last two are enough to vacate, the judge even noted during the trial that awards have been vacated for refusal to examine an investigator before

I have read three articles about this at work this morning, and I still have no idea how this justice justified lifting all four games with the drop of a gavel. The only new quotes from the justice I keep seeing are:

..."premised upon several significant legal deficiencies,''...

..."Brady also had no notice that his discipline would be the equivalent of the discipline imposed upon a player who used performance enhancing drugs,"...

That really doesn't tell us anything.
 
I'd love to see the crossover between people who are fine with the Patriots cheating consistently and those who support Bernie Sanders because he would make for a more fair America.

Doesn't change that the NFL smear campaign was successful. Just look at all the people in this thread that think there's anything supporting the claim that they tampered with the balls.

This is sooooo good. Not because I'm a pats or Brady fan, but because it's yet another loss for Goodell. Guess I'm listening to sports radio all day at work.
 
Glad this is over. Now we can focus on the eagles and if Tim Tebow is going to make the team or maybe if Farve is coming out of retirement.

If you still think Brady cheated look back and realize that the patriots lost a 1st rounder due to this.

Decision basically hung on:
- Failing to tell Brady he could be suspended for what the league considers not cooperating
- Denial of League for Brady's team to cross-examine investigators
- League withholding evidence

Effectively, Judge Berman found that the NFL Suspended Brady for not turning over all of his evidence, in effect, his phone, and yet, when requested, the league did not provide the evidence to the Players Association or the courts that they were using to suspend it. This would be fine in a kangaroo court like the NFL discipline office, but it doesn't have any integrity in front of an impartial judge.

Some good tidbits:

Courts Questioning of Pash: "So which of the four games [suspension] is attributable to ball tampering,
and which is attributable to failure to cooperate?"

Pash Answer: "Well, the Award doesn't specify, and I don't believe there's any
requirement in the CBA to break it down that way. I think the
Commissioner makes a judgment, and he says this in the Award, he says
taking the record as a whole, considering all of the factors, he determined
that a four-game suspension was the appropriate sanction."

Court adds that the league based Brady's suspension on similar rulings regarding Anabolic Steroid use, which as defined in the CBA has a rigorous testing procedure. The court finds that there was no testing procedure related to deflated footballs, so the league cannot apply a punishment. Pash was unable to make a connection between punishment for steroids and punishment for deflating footballs.

Court: So I ask you the same question ... how is [the Steroid Policy]like
deflating a football and not cooperating? Clearly the question is a fair
question to pose because clearly Mr. Goodell felt that he had to explain
[Brady's] four-game suspension. And his explanation about steroid use, in
my mind, only raised more questions than it answered, because I don't see
-I still don't see how the four games is comparable to a player using
steroids and a masking agent.


Pash: I think in the Commissioner's judgment it goes to the integrity of the
game.

Good answer.

The Court finds that no player alleged or found to have had a general awareness of the
inappropriate ball deflation activities of others or who allegedly schemed with others to let
air out of footballs in a championship game and also had not cooperated in an ensuing
investigation, reasonably could be on notice that their discipline would (or should) be the
same as applied to a player who violated the NFL Policy on Anabolic Steroids and Related
Substances.

He listed three great reasons for it. And he never had the option to reduce the suspension. It was one or the other. He gave the two parties a month to negotiate something better.
 
on one hand, the patriots and brady are cheaters and should be punished.

on the other hand goddell's power grab rubs me the wrong way as someone who cares about having a process where the players know what the comish is going to do.

that being said screw tom brady and screw the Goddell for not being able to fix their league.

What power grab? The union agreed to give him all the power.
 
I don't really like Brady, and I thought the suspension was horseshit, brought on by ESPN's whole "11 of 12" false claim.

Don't worry about JG, Patriots will pull off one of those WTF trades and somehow get a 1st rounder for him. I'm assuming the second Carr goes down with an injury.

Here's the basic deal with this court case:

  • It was not about the actual case against Brady. Federal Judges are not allowed to rule on the facts of the case
  • It was about the process. The decision that has to be made was whether or not the punishment and appeal process was conducted fairly
  • The judge decided that it was not
  • In his argument he cites 3 specific things he feels make the process flawed:
  • - The rules never said that anyone could be subject to a suspension for tampering with balls
  • - The league didn't allow Brady's team to cross-examine a key witness during their appeal
  • - The league didn't allow Brady's team to see any of the background information for the Wells report during their appeal
  • Essentially, the judge is saying that, whether or not Brady did anything is immaterial. The punishment and appeal process was, in his opinion, flawed, and because of that he vacate the punishment

Which is how he had to win this specific case of Goodell's overstepping his authority in the arbitration process.People are ignoring how flimsy the case was to punish Brady in the first place. I can't blame them too much with the amount of misinformation spread by the NFL and Goodell directly.
