Patrick Kane Accusers Attorney: Rape Kit Evidence Tampered with (Up: Faked)

What is going on? This is the most bizarre high profile case I've seen in some time. As of now it makes the accusation look very suspect. The lawyer (that left now) was pretty pissed the day before and the next day he seems completely disillusioned with the new events. I'm quite eager to learn the details about who grabbed the rape kit in the first place. That person botched the whole investigation.
 
Chicago Tribune reporting accuser's friend no longer fully backs accuser's version of events and has expressed reluctance to testify.

This case is going to get thrown out.

*IF* it ends up that the accuser lied about the whole thing...ugh.
 
I don't know if he's innocent or guilty. And I won't venture a guess.

But holy shit, this is an embarrassment for the legal system.

I guess, upon further thought, it's not the legal system itself that I think is embarrassing as much as I think the circus that surrounds cases like this is. I think these types of things don't need to be the spectacle they become.

This is terrible. People need help if they are that affected by a story about their favorite sports team/player.
 
I can't believe the accusers own lawyer leaked the name like he did... probably another reason he left the case.

He showed that evidence bag WITH her name on it on TV... and you can clearly read the name.... also he said her name once as well.

What a messed up situation all around.

I'm not going to post the video, because you can see the accuser's name on the bag as the camera zooms in as the lawyer holds the bag up. It's a pretty uncommon surname as well, so it didn't take long for people to match it up. Pretty poor move by the lawyer to not cover up the name.

Will be interesting to see if we get any details on this, as the Tribune's sources also mentioned that she doesn't fully back up the accuser's story on top of being reluctant to testify.

Second bit is nonsense. Article 190.40 would grant her immunity from what she says in a grand jury. Not only that, being 19 and at a bar is fucking trivial to testifying in defense of your friend getting raped.

Kane attorney Paul Cambria said that a DNA analysis in the case found that samples taken below the accuser's waist contain "a mixture" of male profiles. None of the DNA, he said, belonged to Kane.

He suggested that someone fabricated the evidence bag story in an effort to downplay the significance of the forensic results.

"They tried to undermine the science in the case," Cambria said late Thursday. "That speaks volumes about the credibility of the (rape) allegation."

Erie County DA conference regarding the evidence bag right now.

-Investigation is ongoing.
-Evidence in general is usually placed in cans, bags or boxes
-A rape kit goes in a box, not a bag (demonstrating a sample rape kit box)
-All materials remain sealed in the box
-Rape kits in Eerie County are not placed in bags
-Surveillance video shows chain of custody was not breached in any way

They're rolling the footage now. Pretty clear cut here.

-Civilian accompanying accuser was given bag to put new top in
-Civilian was the accuser's mothers
-Mother was the last person seen with this bag

So in short, mom screwed up big time. She concocted the entire thing EDIT: To be clear, by the entire thing I mean the evidence bag.

She will not be charged because in New York it is not a crime to fabricate evidence that hasn't been formally introduced into a hearing.

EDIT: To be clear, when I say the mother concocted the entire thing, I mean the evidence bag.

The accuser could have absolutely nothing to do with this and should still be considered a potential victim.
 
Kane is probably gonna walk. People will assume that proves the girl was lying. Next time an athlete is accused people will just point to this girl and claim new girl is a lying bitch and the world will keep turning.

Not entirely. The case still exists as it was. The bag thing is at minimum a sideshow.

Now the question is... was the mom acting alone in this stupidity or was the accuser part of it?

The answer to that question has potential to kill the case.

The mom is directly responsible for future cases to be viewed this way. No matter what her intentions and even if the woman is indeed a victim, that is horrendous.

The lack of DNA evidence (no longer just an anonymous source giving that info) combined with this clusterfuck from the accuser's mom would lead a great many people to assume he's innocent. If he isn't, the lack of DNA evidence alone wouldn't have been enough to get him off, but taken with this nonsense with the mother and it's hard to see how they can even try this case now.

Of course they likely won't charge him doesn't mean the girl was lying. That's all I was saying.
