Man sued for $30K over $40 printer he sold on Craigslist

Im amazed none of his victims have sued him back. Every time he files a suite, find a way to counter it for the same amount. Fight fire with fore till he makes a mistake and gets burned.

Because unless you represent yourself it costs tons of money. It cost him nothing. He'll go toe toe with you for years and years filing motion after motions.

Vexatious litigation we call them under Scottish Law and if branded that then no cases can come before any court unless that person goes to the Court of Session with the case and has cast iron proof something is actually done wrong.

This guy should be banned from abusing the court system, disgraceful that small technicality has caused this guy who has sold a printer all this money from this greedy bastard. He isn't seeking justice he is just lining his pockets.

Yeah, in Canada too. This man would have been declared one long ago, this level of abuse of the court system is ridiculous.

How is this even possible? Shouldn't it have been sent to small claims court so he could get his $75 back? 30 fucking thousand? What a goddamn joke this country's court system is.
 
What boggles the mind isn't that he's asking for obviously ridiculous amounts of money that greatly surpass the value of the original item in question, but that the US legal system sees this and actually takes his bullshit seriously to the point of eventually awarding him the cash.

How the fuck does that happen, how the hell aren't lawsuits like these immediately tossed into the nearest garbage can, why hasn't this man been verbotten from proceeding with this charade years ago...What a disgusting circus the US legal system can be.

It's quite possible that the stuff he buys does work, too! The first case was thrown out because he "threw away" the printer and it couldn't be verified what kind of condition it was in, IIRC.

Due process.

Even if 99% of the lawsuits he files are shit, you still gotta look at the 100% to make sure the 1% isn't trashed.

Real question is why isn't he fined for all the shitty lawsuits. Or not fined heavily enough.

Fair enough, although eventually he will find himself going up against someone who has the time and attitude to take him on.
 
What an asshole.... we had a guy that worked here that had 4 lawsuits pending against 4 large stores like WalMart, Target etc. And of course when they finally fired him, he turned around and sued the company for wrongful termination
 
Ugh there needs to be a Newegg equivalent (patent troll opposition) for this situation to fight this type of litigation trolling. How ridiculous.

That is also true. Curious if he picks easy target items. Camera and printer seem pretty easy to say they are broken.
 
Why is it horse shit? What's the alternative? Not responding means the other person is stuck and can't do anything? Why would anyone ever respond then?

There ought to be a happy middle ground. If we can have a statute of limitations on crimes as serious as rape, why not for small claims?

I agree there should be a statute of limitations, but that assumes this current judgement has the entire history in front of the judge which is unlikely. Ignoring that aspect of it, I was merely going on idea that it's bullshit to have a ruling against your favor if you ignore responding or complying to the lawsuit. I don't think that aspect is bullshit.
 
The legal system is a fucking joke. They should have laughed this guy out of the courtroom the second he walked in, and told him to go fuck himself. Shit, if I was the judge, I would have charged him 40 bucks for wasting everyone's time.
 
So many people failing to read the OP. I don't know how you see the judge that awarded him the case but miss the big paragraph right above it explaining why.
 
How can you lose one lawsuit over the same case, keep suing over the same shit, keep getting it thrown out of court, and just keep going until someone accidentally fucks up. How is that even legally possible?

Its possible because our legal system allows it. Its bullshit, its easy to abuse, and it can ruin lives. But good luck trying to pass a law to stop shit like this from happening, because lawsuit trolls would come out of the woodwork to stop it.

when you're the best(tm) you're reluctant to see the need to change yourself, because you're the best(tm). so people have figured out how to use this centuries old system's loopholes to manipulate it to their end. Usually its some rich person who does this daily, or its a state entity. But this guy figures it out and he's the asshole? He's the symptom of a system of assholes, run by assholes, for assholes to abuse.

This is the real point to take away from the story.

Judges are

1. Bound by a set of rules and principles that, judging by the replies here, 99% of the people in this thread have absolutely zero understanding of (and that's ok!)

2. Human, which means that yes some are bad or a joke. But you're still way off thinking that is a general rule.
 
That's a dangerous game that guy is playing. One of these days he might cross somebody crazier than him. People have done things for a lot less than being sued.

I think he's referring to how he kept going after him with different filings until he was able to get something in his favor.

Also, statute of limitations only apply to the institution of a claim, not to different filings related to it (like motions and so forth). If I remember correctly, the current matter this story is based on stems from the small claims action started in 2010.

I think a lot of people read the OP just fine. It's still bullshit. The dude basically spammed lawsuits in varying levels of the judiciary until the guy finally failed to respond to one of the dozens and dozens of summons.

Fines they are used for pretty much everything trivial. It's ridiculous to call a case closed because no one showed up to defend themselves that's just prone to abuse.
 
Watching John Oliver yesterday makes me think this system is busted.

Debt Collectors file lawsuits a thousand times a day that lawyers have to read a case in 4 seconds, and if the person doesn't even know he got sued because of the amount of paperwork that could get lost, they lose the case by default.
