No. That isn't a blatant breach of the "stay strong" agreement. If he had said, "We would be better off without Microsoft," then there would be a problem.

Having said that, this still isn't a breech of anything in the Microsoft/Activision contract that Microsoft could use to wiggle out of the $3 billion.

Cause it's not like the UK is ignoring any laws with it. Just blows my mind. Especially after the giant dummy spitting Kotick & Smith did after initial block. Not respecting the UK process and going full on fuck them and fuck that country mode.

MS biggest obstacle is the renogation. After that, they need to overcome the original decision. Then try and to get appropriate remedy in order to get it approved. All of that, while racing the dead of the deal.
CMA can delay their decisions as long as they want to and drag MS appeal.

My memory is fading on the CMC from yesterday, so running out of material... 
but, my last observation was when the judge was discussing with ATVI's counsel as an intervener the issue of them and Microsoft potentially duplicating submissions adding to unnecessary paperwork, and ATVI's counsel and Beard were saying all the right things, giving off the impression they were fully aligned, and then it all looked a bit weird for a minute when the judge effectively told them to operate as one submission. To me it seemed like the body language of the two leading counsels changed immediately.
It was like they'd been asked to dance with their sister and initially it seemed like it was because they each have a client and it was about their duty to the client and billing, but in the minutes that followed when they'd worked out how they were going to use a word document, the body language and angle of each counsel to each other looked more adversarial IMO than before, and only at that point did I realise the guy that was sat very close on the CMA first chair's left side - throughout - was maybe ATVI counsel and not CMA.
IMO it also felt like Beard's Eu expertise and reference to the electronic document system that the EU use for tribunals, he said should be used for this tribunal went down like a lead balloon with the UK CAT judge. IMO Beard only fully recovered his Britishness stature with the judge when the discussion of tribunal wording of England & Wales, and the absence of Scotland and Northern Ireland came up,- Beard legally asserted the tribunal decision would be for all of the UK and the judge could legal decide either way.
The part of the CMC I missed slightly and didn't then understand was the comment about the "potential car crash" comment from the judge to the CMA counsel about the public information versus confidentiality/disclosure being his "car crash" and wondered if this was why Beard became slightly more tense, if the confidentiality/disclosure issue was actually his client's exposure, or if it was something completely different. I only wondered that, because the CMA counsel look completely at ease after the judge was taking ownership.

Umm...super weird update...given the tone of the previous internal mails he wrote even when CMA actually blocked the deal...
Maybe the lawyer was not bluffing yesterday when he stated that delays in the appeal process could jeopardize the deal.
