Regulators focus should be on prioritizing the interests of gamers rather than Sony's, as demonstrated by their decision to block the acquisition. Fortunately, the courts recognised the significance of this perspective and overturned the regulators' ruling. Moving forward with the acquisition is in the best interest of gamers and should be pursued.
 
They can still avoid to go into further legal battles, they can cancel all risks (as small as they can be) that something weird happens after the acquisition is closed (when/if).
FTC has no chance to win. There is no risk for Microsoft there anymore. Getting PI was the easiest path FTC could use and they failed there. Each next step is harder.

By and large, the recent event demonstrated that with the current FTC, the best path forward is to force them to file for the injunction and deal with them in the courts.

The MLB talk brings back memories. A game that was primarily a Playstation exclusive, not only going multiplatform on competing platforms, but Day 1 on Gamepass as well right alongside the full-priced version everywhere else.

If I'm not mistaken (and I just might be), this was one of the arguments that Jim brought up in regards to Bethesda and AB, where Xbox could still "harm" Sony by Microsoft releasing those games Day 1 alongside full-priced versions everywhere.

Given from the get-go everyone was saying FTC had a weak leg to stand on, you'd think the FTC lawyers themselves would notice that even more.

If it was always going to be a losing situation (unless the FTC truly thought they'd win???), their best recourse would be to do what the CMA did and try to hash out some concessions from MS. Which is what MS/CMA are finalizing now. The MS counter offers have been swirling around for ages even going back to the Nintendo 10 year deal last year. So it shows MS will talk at the table.

So after all is done, the UK organization pulled off more concessions from MS than the US FTC did. Crazy.

Yeah but the MLB decision was purely from MLB's media wing, it's not an MS first party game so they couldn't make it launch on game pass without MLB's go ahead.

If it was always going to be a losing situation (unless the FTC truly thought they'd win???), their best recourse would be to do what the CMA did and try to hash out some concessions from MS. Which is what MS/CMA are finalizing now.

We don't know that to be true at all.
 
The CMA have talked about having owenership/control of key gaming IP going into an era of cloud gaming growth and what impact that will have on competition and consumers. It's all there in their final report.

The most likely scenario is that if there are to be specific requests regarding COD then they will be for cloud gaming only.
Again cloud. So the remedy should be cloud.

Stongly disagree with this. Inspire of what people think in here, we do still buy games that are not in the service. How else am I gonna play cyberpunk, Elden ring and so many other AAAs? I still have to buy these games if I want to play them, and I do.


Between my backlog and gamepass I always have something to play and my desire to play is never diminished ( I have 700 games spanning every generation of Xbox in addition to what game pass offers up)


So yeah. I have to disagree as an actual Xbox owner. You can't tell us we are less into games because we bought gamepass. It sounds crazy to read bro! I'm no less of an enthusiastic gamer, so I'm not sure why you would claim that to be the case.


Besides Some People lose desire for gaming because they grow out of it naturally too. Has nothing to do with sun services. I mean…. People don't have less desire for movies and music because they can subscribe to devices for them do the? Why would you think that applies to gaming?

I guess it depends on what your definition of forcing hands is. Sony's license to use the MLB and their assets/IP ended. When they fleshed out a new deal, the MLB negotiated the ability to port and self-publish on other platforms.

So it's either allow that, or risk losing the MLB license. It's pretty straight forward.

You also have to keep in mind that while it's correct no one currently has an exclusive license to use the MLB, the only other major player (2K) hasn't been in that space for 10 years now. The reason for that is because Sony's franchise was indeed the best baseball game and it wasn't profitable for 2K to continue the franchise and compete with a better game on the biggest install base.

With no other players around, the MLB license was sort of a quasi-exclusive. Not so much in the sense legally, but definitely practically. Sony definitely didn't green light The Show going multiplat out of the kindness of their heart. It was agree to that or risk losing the license.
 
Correct. But removing it from cloud solves the problem then. No more competitive advantage in cloud.

Perhaps, but the CMA has said they do not believe in these kind of remedies because it is difficult to monitor and verify that corporations hold to doing what they say they are going to do.

You really think Sony made the choice to make an Xbox version all by themselves? It was part of the contract renewal. Matter of fact, it's MLB themselves who publish the Xbox version. And it was MLB themselves…. Not Sony…. Who suggested the game goes onto gamepass. This article is from back when they first announced it for Xbox. I'm curious, is it available on PS+ these days?



Yes, but it's not like Sony isn't getting a cut out of the sales on other platforms. They would, otherwise, there's no point in pursuing MLB The Show. They'd just shut it down.

The great coup did absolutely nothing to hurt sales. They doubled their sales after it went multiplat and sold millions of packs.

This isn't accurate. Both xbox and Nintendo had rights to the MLB license. They couldn't make a game or had no desire. Sony wasn't going to lose the license, it was going to be opened up to 3rd party. Sony kept it closed to console as it already was and doubled their sales.
 
If Sony firmly believes that COD will become exclusive in some form until next gen maybe is time to let it go when they are still the dominant console and access better the situation of leaving without COD revenue.... I dont think is that crazy ... but who knows what the fuck will happen

That money they were spending on marketing CoD could go to promoting competitors. Both their own games from Bungie and Firewalk, as well as third-parties like Ubisoft (XDefiant) or EA (Battlefield/Apex). Seems Valorant might be coming to consoles. Could toss some money at Riot to market that as well.
 
If MS actually try subvert the CMA's decision and close the acquisition against it I genuinely hope the subsequent fines, asset seizures, financial sanctions, and other assorted responses deployed by the UK government are so severe that MS execs are forced to shutter the Xbox divsion and beg on their collective knees for a reprieve before their shareholders have them executed.

It would be a real shame if Sony had to start having their studios make good shooters like killzone or resistance instead of open world theme parks and marvel ip games

Yeah

I think Sony is going to re-allocate that money into Bungie's games for marketing. CoD will still be important, but they're going to try and ween people off of CoD and onto their own Live Service games.

This also feeds into their plans to make Bungie's IP cross TV/Movies for wider appeal. Essentially this is a race between MS to continue CoD dominance, and Sony to erode its dominance.

Old CoD games are about to get a second life and they're already having sales on the DLC packs for them. They're gonna make bank on 2 generation old games.
 
Sony was dumb for dropping SOCOM. ABK is taking their lunch with all of those 3rd person MWII modes.
I agree. But you know, Sony probably considered the cost of keeping the servers up and running and just didn't want to deal with such a passionate community when they shut down the servers after about half a decade.

You can do both. Perfect chill game where you don't have to pay too much attention to what you're doing.

I wonder how MS will feel when this acquisition does nothing to significantly increase their hardware sales 🤔

It's going to boost gaming revenue by up to $8bn per year, drive GamePass subscriptions and give them a significant presence in Mobile.

COD will remain multiplatform so I'm not sure why you imagine this was about a fundamental shift in hardware marketshare.

Probably barely pulled revenue in, which is fair to say. Many devs could make a game better than COD, but COD sells on its name alone, which is something a new competitor like XDefiant has to overcome and it is almost impossible at this point.

Dont get me wrong this is great news because I still love BO 1,2 and MW3 but it just shows how much of a piece of shit company Acti is because all of those games plus dlc were pretty much selling for full price and they knew the servers were fucked and still charged 50 a pop for these

Lotta folks are tired of COD too though, me included. I would go back and play the old Zombies but the novelty would wear off quickly I believe. I loved Transit. Just really good times from back in the day. I would probably play through the campaigns for those more futuristic CODs as well.

People can have a range of opinions on events that happen in gaming. You want this to happen. He clearly doesn't. Does it really bother you that he isn't OK with it?
I would also prefer this didn't happen, and I have both consoles. I don't see the advantage in one company brute-forcing their way to the top by buying big publishers. I am also not blind to the fact that, even if I don't see it right now, this could end up being a good thing later on.

Everything is not black or white. The carrot MS is dangling in front of us (e.g., games on Game Pass) might seem good right now, but there is no guarantee that it will be for the long term. We just don't know. So, there is no need to engrave your opinion in stone and try to be a little flexible, more open minded.

What if Bethesda want to make a game for PS6?

Its makes perfect sense…Prior to PS5 launching Activision had access to proprietary tech to ensure CoD took full advantage of things like Haptics etc, Sony stated that going forward,so PS6, that Activision under MS would not be getting the same level of access since that would reveal aspects of the PS6's hardware and software to MS…I honestly dont understand what you dont get here…Sony doesnt want MS having inside knowledge of its hardware…SO if they did decide to publish on Playstation which lets be real is going to miniscule if at all, the releases will be unoptimised for PS6 hardware.
So if Bethesda requested Xbox allow them to publish on PlayStation (They wont beyond low level releases like Quake 2 Remaster) expect that those games wouldn't utilise the Playstation hardware properly after this gen.But thats not gonna happen anyway…
