FTC has no chance to win. There is no risk for Microsoft there anymore. Getting PI was the easiest path FTC could use and they failed there. If I'm not mistaken (and I just might be), this was one of the arguments that Jim brought up in regards to Bethesda and AB, where Xbox could still "harm" Sony by Microsoft releasing those games Day 1 alongside full-priced versions everywhere.

If it was always going to be a losing situation (unless the FTC truly thought they'd win???), their best recourse would be to do what the CMA did and try to hash out some concessions from MS. Which is what MS/CMA are finalizing now.

The most likely scenario is that if there are to be specific requests regarding COD then they will be for cloud gaming only.

You really think Sony made the choice to make an Xbox version all by themselves? It was part of the contract renewal. Matter of fact, it's MLB themselves who publish the Xbox version. And it was MLB themselves…. Not Sony…. Who suggested the game goes onto gamepass. This article is from back when they first announced it for Xbox. I'm curious, is it available on PS+ these days?

Between my backlog and gamepass I always have something to play and my desire to play is never diminished ( I have 700 games spanning every generation of Xbox in addition to what game pass offers up)

This isn't accurate. Both xbox and Nintendo had rights to the MLB license. They couldn't make a game or had no desire. Sony wasn't going to lose the license, it was going to be opened up to 3rd party. Sony kept it closed to console as it already was and doubled their sales.I guess it depends on what your definition of forcing hands is. Sony's license to use the MLB and their assets/IP ended. When they fleshed out a new deal, the MLB negotiated the ability to port and self-publish on other platforms.
So it's either allow that, or risk losing the MLB license. It's pretty straight forward.
You also have to keep in mind that while it's correct no one currently has an exclusive license to use the MLB, the only other major player (2K) hasn't been in that space for 10 years now. The reason for that is because Sony's franchise was indeed the best baseball game and it wasn't profitable for 2K to continue the franchise and compete with a better game on the biggest install base.
With no other players around, the MLB license was sort of a quasi-exclusive. Not so much in the sense legally, but definitely practically. Sony definitely didn't green light The Show going multiplat out of the kindness of their heart. It was agree to that or risk losing the license.

Regulators focus should be on prioritizing the interests of gamers rather than Sony's, as demonstrated by their decision to block the acquisition. Its makes perfect sense…Prior to PS5 launching Activision had access to proprietary tech to ensure CoD took full advantage of things like Haptics etc, Sony stated that going forward,so PS6, that Activision under MS would not be getting the same level of access since that would reveal aspects of the PS6's hardware and software to MS…I honestly dont understand what you dont get here…Sony doesnt want MS having inside knowledge of its hardware…SO if they did decide to publish on Playstation which lets be real is going to miniscule if at all, the releases will be unoptimised for PS6 hardware.This argument makes no sense or whatever, considering MS owns Bethesda.
