It's funny, in my family I have 2 iPhones, an iPad, a 2008 MacBook Pro and a 2009 MacPro, and I've been on Samsung's side the whole time.

Apple have been complete dicks in all of this, and this was nothing more than Apple wanting to fuck up a genuine competitor. Not on.

So does this mean Samsung will go mostly Windows Phone 8 now?

You're not alone. I have an iPhone 2G, iPhone 4S, and iPad 3 and was hoping Apple wouldn't win this. I like their products but I know for sure I'm not going to just stick with and keep buying Apple products for the next 15 years.
 
Verge making a good point. Will likely push Samsung and the rest more towards Windows Phone 8 due to Apple's partnership with Microsoft to allow the Microsoft OS to use their patents.

I agree with Nilay, its time for Google to settle and pay up. Indemnify their OEMs.
 
Apple don't have to and have said they won't license it.

Oh well then that's just shitty. I was fine with this patent situation because I just assumed the other companies didn't want to pony up for someone else's invention, but that is ridiculous and anti-competitive.

Can you link me to a source on this before I change my opinion?
 
Am I nuts or did Google intentionally leave pinch to zoom out of earlier versions of Android just so they wouldn't infringe on Apple's patent?
 
I'm personally happy that Samsung's counterclaim was slapped down hard. Using standards essential patents as leverage was far worse than claiming ownership of something Apple did actually develop and patent "properly".

If there's anything else to be happy about it'll hopefully start to drive big companies in the Valley to push patent reform within Congress.

Here's hoping, 'cos the patent trolling needs to stop.

I think it's the other way around, time for OEMs to start paying up to Android so they can pay up. Google can't afford to pay for all of these patents as they are just making money off adsense and purchased apps/content (the second not being that much on Android, the first being huge) through Android.
 
Why didnt Samsung just pay for the patent use?

Don't understand why people are saying "if the notification patent goes through, Apple are in trouble"' you can't counter sue for patents if the patents haven't been granted
 
I knew samsung was not beating apple in a american courtroom. So this means apple can basically get rid of about 95% of smartphone competition and claim the market for themselves right? No one would buy a smartphone without gestures like pinch to zoom.

anti-trust? for what? they have no monopoly on anything. why do they need to be broken up?

I'm going to ignore your tag but this is a stupid comment.

They are in no way a monopoly, and I don't really like the company nor own anything of theirs save for a 7 year old ipod.

I'm incorrect. They did eventually soften up on it and offered them a license in November 2010. I suspect it was ridiculously high or something similar as a middle finger to Android vendors as well. At the time the feature debuted Steve was enraged and wasn't going to give them shit. Here's from the deposition:

During Forstall’s deposition on Tuesday, the Apple SVP told a jury that Steve Jobs expressly and unambiguously stated, “Here’s something we invented. Don’t — don’t copy it. Don’t steal it.”

Forstall explained that the rubber banding effect (381′ patent) was something Jobs cared deeply about. The rubber banding effect, otherwise referred to as inertial scrolling, occurs when a user scrolls “past” the end of a document or Web page.

“I actually think that Android had not done rubber banding at some point and it was actually added later,” Forstall said. “So [Android] actually went from sort of, you know, not yet copying and infringing to — to choosing to copy, which is sad and distasteful…”

Yep. There you go, back to my original opinion. You gotta pay for someone else's R&D.

As long as they offer the technology/patent to be licensed, then this is ethical from a business standpoint.

There is a lot of confusion here. IT MEANS THEY JUST HAVE TO PAY TO USE SOMEONE ELSE'S TECHNOLOGY/PATENT.

You've had this for a long time in electronic devices like TVs, dvds, blu rays... Microsoft and Apple share enough patents between each other that they just made an agreement... the free ride for Android OEMs is over.

EDIT - Since a new page. The sum of it is you have to pay for someone else's R&D. Nothing's free.
