and that patent and implementation rumor already look more user friendly than ms solution, no need for always on connection, used game disc go to demo mode, can buy 'online pass' to activate the full game

If both Sony and MS do it people will adapt and they will adapt FAST. Shitty but thats just how it is.
Personally I buy my games 95% new and never sell em. Only problem I would have is lending the games to friends. Always online would be too much for me even when I have my consoles almost always online.
You know that wont happen :/. Nintendo would just be walled off from third party games.

Maybe it's because people on Gaf understand that it's going to really put a hurt on the business as well?

This and the fact the company the size of Microsoft would be able to tie up any lawsuit in litigation for so long that by the time a verdict is rendered the damage would already be done. If they do this, Microsoft will already have already plotted out contigencies in how to combat the inevitable lawsuits that will follow.

You know, as a primarily PC gamer, I'm fine with this on the PC side, as companies have been doing the 'no second hand' in essence since the days of Starflight and the AD&D Gold Box series to combat piracy.
But for consoles, fuck that. Lending and trading games with friends is just something you do. It seems like these big media companies try to force this shit down people's throats as well. They 'brute force' draconian measures that are not consumer friendly into the marketplace, and hope consumers adopt due to apathy.

I think they will likely have some share in this new possible system, maybe not as lucrative as it is, but they can sell retail codes or else.

They've sold 70m, how many of those were second-units/sitting in a closet/rotting in a landfill/etc.? Probably around 30 million honestly.
My guess is that:
1. an extremely high percentage of active 360 users are online
2. an extremely high percentage of new 360 owners go online.

Pretty much. I just don't see them after doing all they did to gain traction in the industry to see, "ok, now lets piss it all away". There is arrogance and there is plain stupidity, like MS or not they didn't get this far by being stupid.

Wasn't that shot down? Certainly, I still expect Microsoft to get some legal hassle in the US (and definitely in the EU, and the EU version might get shit done).
Problem is it also affects people who like to lend their games to friends. Reducing this to the second hand market is a mistake (even though I guess Sony/MSy probably don't care about that at all).

Can someone provide research/stats supporting the assertion that console gaming is completely reliant on the used games market, because apparently it's an indisputable fact around here. I don't care if it makes sense in your head or if you wish it to be true, provide some evidence

Key difference is first party royalties. With $6-8 going to the console mfg for each game unit sold, prices on console games will never go as low as on PC which has no 1sf party royalty.

Microsoft just shot themselves in the foot.
I don't know how much the rest of you know about American culture (I'm an expert), but offline and used games are huge parts of it. It's not like it is the PC platform where you can become successful by being digital. If you screw someone over in America, you bring shame to yourself, and the only way to get rid of that shame is repentance.
What this means is the american public, after hearing about this, is not going to want to purchase the next Xbox, nor will they purchase any of Microsoft studio's games. This is HUGE. You can laugh all you want, but Microsoft has alienated an entire market with this move.
Microsoft, publicly apologize and cancel these restrictions or you can kiss your business goodbye.
