The way Tony spoke (in that convenient "Hey, Tony, tell the viewers what's up" dialogue), it seemed as though Jack convinced President Palmer to pardon Tony...which would mean Tony was in jail for less than three months, since Palmer lost the election at the end of last season.

Well I don't think they are trying to be unpredictable, there is a reason why they zoomed in on the car keys to the door when Mariane was trying to get in to the car.
