The acting Attorney General Sally Yates has told Justice Department lawyers not to make legal arguments defending President Donald Trump's executive order on immigration and refugees, according to sources familiar with the order.

The move sets up a dramatic clash between the White House and the Obama-appointed Yates.

"My responsibility is to ensure that the position of the Department of Justice is not only legally defensible, but is informed by our best view of what the law is after consideration of all the facts," she said in a letter. "In addition, I am responsible for ensuring that the positions we take in court remain consistent with this institution's solemn obligation to always seek justice and stand for what is right."

"At present, I am not convinced that the defense of the executive order is consistent with these responsibilities nor am I convinced that the executive order is lawful," she wrote.
But Yates is only serving until Trump attorney general nominee Jeff Sessions is confirmed, meaning her decision is likely extremely short-lived because her order is enforced only until she leaves office.

"This will be moot. Then we will very much see the Trump Justice Department led by Jeff Sessions defend this executive order pretty vigorously. And then it will be up to the courts," said Steve Vladeck, a CNN contributor and law professor at the University of Texas School of Law.

Currently, there are cases filed in at least five states including Virginia, New York, Massachusetts, Washington and California that are challenging Trump's order.
The decision effectively grounds the executive order for the next few days until Sessions is sworn in.

The White House could choose to fire Yates and install someone who will carry out the administration¹s priorities, but it did not immediately respond to a CNN request for comment.
Trump's executive order, signed Friday, bars citizens of seven Muslim-majority countries from entering the United States for the next 90 days and suspends the admission of all refugees for 120 days.
 
Hopefully the (few) remaining Obama appointees and staff continue to fight the good fight like this, for however long it can last.
 
So realistically, how long can we hold off Sessions for? When it does come to a vote, even the best case scenario is that he's confirmed 52-48, but how long can we actually hold off the confirmation?

That does nothing. Trump can fire her this second and put someone in temporary.
 
There is nothing the Trump administration can do to you that is worse than what the history books will say if you do as you're told.

They should demand another round of questions. They have the right and the justification to delay jim "maybe he's a race traitor" sessions for as long as they need to.

At any rate, she's going down as a hero. Democrats need to take fucking note.
 
Waiting on confirmation from other sites other than the Alt-Gov Twitter feeds, but it looks like they want to bump up Sessions' confirmation hearing to tomorrow.

I think he means "Now the Dems have an Obama-appointed Attorney General" (as if she wasn't there before) in addition to DEM obstruction tactics.

Donald Trump complaining would work if most people liked him. But guess what, they don't. And most people blame those in charge when government is slow and obstructed, as we've seen over the course of Obama. So their constant attempts to blame other people aren't really doing anything.

Well, sorry ya cheeto stained fuckwit. We learned after the last 8 years that delaying and obstructing purely for political reasons results in enormous power. Seems like that's the right way to go.
