A federal judge in Boston today set a November trial date for Dzhokhar Tsarnaev, the young man charged in the deadly Boston Marathon bombings that shook the nation last year, raising again the specter of terrorism on American soil.

US District Court Judge George A. O’Toole slated the trial for Nov. 3, much sooner than the earliest date suggested by defense attorneys in the high-profile death penalty case.


Judge O’Toole said the government’s request for a trial this fall was more reasonable than the defense’s. The defense had asked for a trial in September 2015, at the earliest.

After the hearing was over, bombing survivor Marc Fucarile, said, “I think it should be sooner. Why not? Everybody should be on the same page. It’s pretty cut and dry with the evidence. Don’t waste anybody’s time.”

O’Toole set another hearing in the case for June 18. The two sides are expected to discuss that day whether the defense wants a change of venue.

Defense attorneys also argued today that they are not getting access to evidence they need to prepare their case, including 2,000 items still being analyzed at FBI headquarters in Quantico, Va.

Tsarnaev, 20, who did not attend the hearin, is facing numerous charges in the April 15 blasts that killed three people and wounded more than 260 others. The blasts, which tore through the happy crowds at a world-renowned sporting event, made headlines worldwide.

Tsarnaev and his brother, Tamerlan, 26, also allegedly killed an MIT police officer in Cambridge a few days later as they sought to flee the area. Tamerlan Tsarnaev, who also allegedly participated in the Marathon bombings, was killed in a confrontation with police in Watertown several hours later.

Later the same day, Dzhokhar Tsarnaev was captured, hiding in a boat in Watertown. Authorities say he had been inspired by Al Qaeda publications and had allegedly scrawled in a note on the boat that he had acted because “the US government is killing our innocent civilans. ... We Muslims are one body; you hurt one, you hurt us all.”

What the fuck, this shit happened almost a year ago, why haven't they already had a trial?

Rushing into a trial just to appease the public's bloodlust is the most stupid action a legal system can take.

Relax, take it slow, ensure that the case can be properly and comprehensively presented on both sides, and for Christ's sake don't attempt a flimsy and rushed trial that will collapse under appeal.

I honestly don't know how they should handle it though.

Giving him the death penalty is so easy, he will be dead. Keeping him alive and making him suffer is what most people want, but what does that do (and they don't torture people because it's a no-no)? Tax payer money goes to keeping him alive.

They need to gather evidence, prepare a case, go through the motions, have hearings. All sorts of shit. They only have one shot to get a guilty verdict. You don't want to act fast in a case like this.

A quick Twitter search shows that there are still people who want him to go free. I understand how some people are flat out idiots, but how anyone can relate to this evil person disgusts me.

I can see the prosecution taking death off the table if he pleads guilty, but he will be in supermax for the rest of his life.

I think they should just make him work until he dies for the betterment of other people, but then some people will be like "no I don't want nothing from that terrorist scum!"

I think keeping him life in prison will be good enough though. Making him die is the easy way out.

Going by the evidence, the trail won't be about guilt or innocence(guilt as all shit). Just to see if he will die or get life.

So why are they waiting so long, is there a chance he can escape on legal technicalities or something, or is the delay just to make sure he doesn't?

Guy is 20 years old. I'd argue that the death penalty is far more humane in this case than locking him up for ~60 years in a supermax prison somewhere out in the rocky mountains.

If I were him I'd be hoping to be executed.

Reading up on it, the defense has been trying to stall the trial until Sept 2015

If I were him I'd be hoping to be executed.

Prosecution likely wants time to build it's case and the defense wants time to distance itself from the event. Once delays are no longer mutually beneficial, the trial starts.

It isn't a question of doing what the criminal wants or not. Some people don't want to be a part of state-committed murder.

I'm surprised they're even pursuing the death penalty in the first place as it opens the door for a very controversial discussion on state sponsored executions. The odds of him actually receiving it are low.

There is a finite number of judges who can hear the case and who have a finite amount of time in which to book them, even in a small rural area as the one I live in the Judges are booked with cases months in advance. Waiting for the fall of this year isn't that strange a wait for a case this complex (and likely needing a large block of the Judges time).

That message he supposedly wrote on the boat seems so...forced. Like it was perfectly designed "hey guys! Fear the mozlems!! The US government is doing these things, so we're attacking civilians!!!"

In any case, they should lock him up. That's a far worse punishment than death for a 20 year old.
