Well, based on cursor motion, I'd say they were showing us the PC version...which can have a variable framerate depending on hardware. We don't know how well it will run on 360.but hopefully they can improve it a bit before release... ditto on the framerate.

Any Oblivion content on Live is going to be official Bethesda stuff. So inevitably when people make better looking models and animation 360 users will be out of luck.
