I also think the optics of playing politics like that, after spending months of accusing Senate Republicans of playing politics over Garland, would also not be a very good look.

That too, but he's got a really good record of his opinions being upheld and he's exactly where Obama wants him to be in regards to gun control. If he gets put on the court and nothing else changes then Heller is still going away the next time it's challenged.

Just to remind people, 3 of the justices were born in the 1930s. Only Thomas is from the 40s. Everyone else is 1950s and the youngest is from 1960.

At least he might've gone with a more middle of the road choice in order to get something through before he left office.

Now Clinton has the ability to step in and select the candidates she really favours.

What are you going to pubbies? Block 2 supreme court nominations for 8 years?

If Republicans did that, it would still be a 4-3 or 5-2 liberal decision.
 
The plan is falling into place. Once Hillary is elected Obama can be chosen as a new Justice.
The amount of GOP salt would sustain me for a lifetime.

Its even bigger than that. Ginsberg and Beyer can step down and be replaced with Justices thatll be on the court for 25-30 years.

Having control of the House and a majority of governors and state houses is certainly going to make it difficult (and is certainly not "nothing"). Also its unlikely Dems will maintain control of the Senate.

I have faith, maybe misplaced, in my fellow democrats voting in midterms thanks to Trump. The House maybe not so much.

You cant overturn an amendment. You can repeal it, but good luck getting 3/4ths of the country to agree to that when all polls say the greater majority of people want to not do that.

People's hatred of firearms on this forum is fucking fascinating.

Yeah I seriously doubt it will happen in my life time. Stricter restrictions, but no ban this century.

The Washington Examiner isn't a particularly notable or noteworthy news source. Not to say he might not actually be considering retirement, but I don't know that this sole report from a not-well-known source is evidence of it.

the second amendment isn't just an amendment. It's apart of the bill of rights. I don't think the federal government even has the authority to repeal it with its current powers. Think we would have to completely start over with a new constitution to get rid of it.

The ones after the tenth are up for grabs though.

Thomas is no dummy, he knows how to read a poll. If he is considering this, he knows who would replace him. Nobody is in any position to put any real pressure on him. What leverage could anyone possibly have?
If forced to guess, I'd bet that he steps down after the GOP likely recaptures the Senate in 2018. That'd be the moderating counter-force in his favor.

The 2018 Senate map is downright brutal for Dems, so any court packing that'll take place over Hillary's first term would be done between 2017 and 2019.

Even if she wins one term, she'd be flipping Scalia's seat and renewing the liberal wing with young justices. A young, liberal 5-4 majority is her worst-case scenario.
 
Why is he waiting? Let Obama pick the next nominee.

Because he's waiting for Trump, so he can get a successor who has similar views.

People don't understand that when he says "considering retiring" he really means "I'll retire if a republican wins the general election. He's 67, so he'll probably wait 4 more years if Hilary wins.

He should have been working with the Obama coalition trying to farther this progressive notions. Instead he labeled Obama, Hillary and the rest of the Democratic party as part of the problem that needed to be overturned.

The only thing that would make this perfect storm for Dems even better is if were happening in 2020 when they could redraw congressional districts. 2010 is still fucking things up.

This isn't good news, this is a Justice using his seat to apply further pressure on this election.
I don't think it will have much of an effect. It'll motivate one side just as much as the other.

It's either a lie or a scoop. Other reporters will dig into it. We will see if there is any more smoke across the next week, I imagine.

Lol. If I remember right only 17 states would have to vote against an amendment. Just off the top of my head, states that would almost certainly vote against any sort of gun control amendment:

I'm all for reasonable control methods, but we are a looooooong way off from passing an amendment of any sort, much less something as polarizing as gun control. Sure we could try, and symbolic voted are important for getting the word out for sure, but it shouldn't expected to pass any time soon.


Until recently the Lord Chief Justice in the UK was Igor Judge, and we still have Lord Justice Laws on the Court of Appeal.

And this is why voting for a viable Presidential candidate that will pick people to sit on the Supreme Court that will continue to move this country forward is so, so important.

If you are implying Bernie, I do not know how once Trump became clear anyone could think he was not viable. At that point it was preference.
 
Thomas's seat on the Supreme Court is unofficially viewed by Congress as the "black" seat as he replaced Thurgood Marshall, the first African American supreme court justice. I could see Hilary make history by appointing the first African American woman in that seat if she were to get elected.
