The FTC has done a good job exposing how much BS certain people spew and proving the risk of foreclosure is legitimate. Think they still have some hills to climb though. Pretty sure I read that the judge made reference to FTC's ability to unwind mergers even if injunction denied, so the difficulty and potential interim harm should be fleshed out. I would want to stress they are currently blocked by CMA yet still trying to close on this. Can show they don't care about regulators all that much and would resist following any future divestment order. Probably a good idea to also hammer home how many consumers could be affected by foreclosure to stress this is protecting US consumers more than Sony.

Well that was a great day for Microsoft. All three witnesses presented well and answered calmly and confidently. The judge warmed to Sarah Bond in particular. The FTC really trying to hammer the anti competitive nature of the merger and each time they seemed to gather some momentum, it was continually lost.
