The problem with these xbox executives is that they lie so much, especially in public. So much so that I don't even think they know what the real truth is anymore.
The problem is so does Playstation, it's called PR. Everyone does it so to speak, so stop acting like xbox is the only villain here.

Microsoft got their shit punched in today. Booty and Hines got wrecked on examination, every single one of Microsoft’s public statements were exposed as lies by their internal emails and testimony by both Hines and Bond.

Anyone trying to spin this as a win for Microsoft lives in an alternate reality or is a paid shill. They absolutely got exposed on EVERY account as being anti-competitive with only one goal in mind: Shutting out everyone else.

FTC didn't win anything today nor did they punch anyone to be exact, they made no point and messed up on numerous occasions.
So either we were listening to the same zoom or you just pulling it out your ass cause it's Microsoft involved.

If the FTC wants to win, it needs a lot a lot more. Of course, discovering that Indiana Jones will be exclusive (even more so when the acquisition of Zenimax was approved without conditions) or that the agreement with Nvidia has standard and common clauses of rupture by both parties is not enough.

That said, there are 4 more days left and surely the evidence and reports against and in favor stronger. I just hope they are entertained like today. The statement of P. Spencer, Nadella and the recorded video of JIm Ryan should be the highlights

It's standard practice to ask common knowledge questions to witnesses. This in no way suggests that the attorney didn't know who Nadella is. Im seeing a lot of similar mocking of the questions the lawyers are asking and I'm wondering if people really don't have a clue about the most basic aspects of trial law?

The FTC's goal today was to show how untrustworthy MS is and they showed that but MS didn't reveal anything anti-competitive that would force the deal to get blocked

Nothing is "for certain". I'm not basing my opinion on one day. I've been saying this for months now. FTC has little to no teeth to stop this. It all depends on the CMA.

If I'm wrong then I'll be ecstatically wrong.

And just like Destin and Ryan did when the CMA said no after they thought it was a slam dunk, they'll react like children who just got their toys taken away if the judge says no to the deal.

It's unfair to say they didn't do anything, they showed that MS lied on exclusivity and were dishonest in their communication and that likely also bleeds into their 10-year contracts, and their promise to Sony. They also redacted (in the audio) another contract with Nvidia signed on the same day as the 10 year deal that was secret that could also look bad, we dunno.

Otherwise, yea, nothing super damning to the deal at all

I can't disagree. I'm against the acquisition but this is a damn tall hill for the FTC to climb. I don't think folks should get their hopes up here.

I'm here for the entertainment as well. This shit is fascinating.

I'm going to give you the benefit of the doubt here and reply candidly.

As an organisation Xbox are in the press pretty much every day with some new soundbite, whether it's from Phil, Booty, Bond or Greenberg. They do this to compensate for pretty much everything else that's wrong with them as a division. In doing this they attempt to "win" the hearts and minds of gamers across the internet via what can only be defined as PR brainwashing. This can work well on the impressionable, vulnerable and marginalised, but to every other rational consumer, they will look at the purchasable products and notice it doesn't align with what's being said.

"everyone does it", or rather "SonyToo™", does not work in this instance because firstly their executives are not in the press anywhere near as much (many would argue they do too little on this front and accuse them of being silent) and secondly they don't have a 70 billion dollar acquisition in process which means every fucking word they say comes under factual scrutiny.

So nice try, but it's not going to wash.

The fundamental problem with the FTC argument is that it’s quite a traditional, almost ‘vanilla’ competition claim. MS are obviously talking themselves down as much as possible, as Sony’s success makes the FTC position harder to maintain.

I agree, today's revelations were pretty spicy for both sides but nothing that could undermine the deal, IMO of course.

What were the remedies? I ask this the second time since the only regulator that failed to disclose their full report, was the EC. So, people are repeating this. What are the remedies?
In short, for the EEA, MS has confirmed that any ABK game can be streamed to any cloud device.

I have a strong sense that if the injunction is denied, MS will try to close it and take care of the trial as it happens. Even that will be closure in some sense.
But I thought that's not possible because the deal between MS and Activision called for FTC and CMA approval as a condition? Then how can they close the deal without a CMA approval without renegotiating the deal first?
