I just googled and apparently subpoena for phone records can be issued in civil cases. The difference from a criminal case being that the party has to pay the price to the phone company.

Apparently happens a lot in divorces.

Destroying his cell phone is a really bad look, guilty or not. Basically undermines any court case before it begins. He must have thought the NFL would settle or back down.

Yep. The Patriots claiming it was his practice to destroy his cell phones is almost as comical as when they said that guy was called The Deflator because he was attempting to lose weight.

Interesting point not known until this point: neither Jastremski nor McNally called as witnesses by the union at the appeal hearing.

Why wouldn't Brady's lawyers want to question the two co-conspirators so they could clear up what his lawyers said were out of context texts?
