I do too. The retail one is not exactly like this one, but the only difference is that the system compartment has a plastic mesh with cutouts for the buttons & volume/power switch instead of those two straps in Marty Chinn's pics. If they detect any homebrew or anything like that on the Wii's system when you send it in for repair they'll return it right back to you unfixed. I see them checking the 3DS OS as well for this. Having checks in place when you access the eShop wouldn't be out of the question as well. They should be able to do this now.
The Wii Shop Channel I don't think was setup to detect anything like this. If they learned from their mistake and have paid attention to how Live and PSN work then this should have been dealt with.
