That is actually the way it works. The accountability in this scenario is the lawsuit lays out the promises of the event, the breaking of those promises and the damages. Both sides will sit down and Niantic will settle the case and move on.
If Space Mountain breaks down and is out of commission, does Disneyworld have to pay for your hotel and airfare expenses?
If you go to a World Series game and it gets rained out, is the MLB obligated to pay for your taxi and hotel stay?
Niantic's only liable for the cost of the ticket. "I didn't have a good time" or "I didn't get what I wanted" is not really grounds to sue for travel expense. Anytime you travel for a concert or event, you're gambling that it won't be cancelled, delayed, or otherwise screwed. That risk kinda has to be on you, and not venues, artists, and promoters.
I suspect Niantic will settle because it's probably cheaper to pay for 30-50 people's plane tickets/hotels than it is to take the case to trial. Hard to say though, because if they give in here it may mean more lawsuits.
