To be fair, the eShop doesn't typically crash during game launches. When AC came out, I was able to download at 12:01 no problem.

It asks if you want to Download Now or Download Later. Click Later. Then go to the home screen, close your 3DS. Open it when you want a progress percentage and click on the gift icon.

If your DL is still going, there's a button on the touch screen that'll let you Download Later.

Choose it and then put 3DS in sleep mode. Open up and tap it to see %. Then close again.

It is far superior to Download Now. It's more reliable for example.
