You shouldn't do it either way, whether the rules explicitly state it or not, whether you're in a privately owned building or not.
Shouldn't this extend in general to "You shouldn't take picture of anyone without their permission, even in a public space"? Or is there something special about cosplay I'm missing?
 
He's referring to cosplayers because you shouldn't take pictures of them without asking for permission. I don't think it's illegal to do so though some conventions started putting up signs because of it.

If you are in public, people are legally allowed to photograph you. They weren't aiming a camera up Orlando's skirt, he was paddling by what I understand was a public beach. Unless I am mistaken, no crime was committed. Is it rude to take a photo of Orlando's penis? yes, fine.

The actors from the fappening actually had an actual crime committed against them.

Beyond the legality, I think it is galling to act like it is the same thing for a man or a woman to have nudes leaked. it just isn't in our present, thoroughly sexist society.

You're right. The post Exploder was referring to was specifically talking about cosplay though which is why I brought it up.

It's not necessarily illegal but that doesn't mean it's okay to do so without asking.

I understand what you're saying, but are there any examples of women celebrities who have gotten fallout from going to a topless beach? (I honestly can't recall.) I sort of feel like there is enough difference and nuance in this instance where the double standard doesn't apply.

Now, if Orlando Bloom was hacked and his private pics leaked, I agree with you in that he likely wouldn't have similar repercussions as a woman. That still doesn't invalidate his right to privacy and the fact that he was a victim.

No, it's more about your using hypothetical fallout as a measure of the ethicality or "okay-ness" of taking a posting a person's nude photo online. Yes, they're in public, but the consequences shouldn't really factor into how relatively okay it is for either gender

I wonder how some of you get your weird ideas about photography. If every person on earth needed to sign a release form before pictures in public were taken we'd have no photojournalism whatsoever. no crowd shots. no news gathering.

and yes that extends to cosplayers in public. private venue can set rules about photography but not a sidewalk or park (or beach). it may be courtesy to ask first (I do) but you do not have to, it's not illegal, nor immoral.
