The real explanation is that Kubo feels that Mayuri represents a "necessary evil" for the Shinigami side. It's why he still gets to live and people who "fight for evil" like Starrk get to die.
According to Ywach the original Gotei 13 were just a bunch of vile killers whose actions eventually led to order and Yamamoto thought that everyone, including his colleagues, were expendable so it kinda makes sense that Mayuri is still around.
Really I wish that Kubo expanded more on the backstory of Ywach and Yamamoto but whatever.

The issue is, that was an interesting idea. Meaning he wouldn't have expanded. It would have been nice for one of those cases were the Gotei were built on the corpses of innocents the entire time.
Kubo doesn't even know what Aizen's bankai is, that shows us how powerful Aizen really is.
