Would be kind of ironic if this gets wiped because the NFL refused to let someone testify when they were dinging the Patriots for the same in the Wells Report.
 
Am I reading this correctly, they wanted to suspend Brady for 8 games?!

Berman is harsh to NFL for second straight week on how they handled Brady's punishment with lack of evidence.

NFL responds by saying they thought of punishing him even harder.

Really helping your case there, NFL.

Judge is clearly putting the pressure on the NFL to come to the table and settle.

They seem to be doubling down and refusing. He's going to cream them if they continue to refuse.

Is it just blind hate for Brady and the Patriots, or do you really think the NFL should be able to suspend players for minor issues and without any evidence?

I just honestly want to see how bad Jimmy G can sink the franchise.

Prepare for irrelevancy (although I can see Bill working his "magic."

Best case scenario is Brady is found innocent, goddell found guilty of smear/sting op, he gets kicked out, pats win 2016 bowl. Someone makes a dope movie about it

Sounds like unless the NFL honestly believes it'll lose, they won't compromise, so Judge is going to play them in a game of chicken until they budge.

Still think Brady gets 2 games for "lack of cooperation" and life goes on.

I still think he will not even get a game. MAYBE one, but I doubt it. So your saying anytime a player does not cooperate, misses a hearing meeting, doesn't return a call ... he is going to miss games? Seriously?

There is no way they would give Goodell that much power.

Brady isn't going to take any suspension because that would be admitting guilt. At least that is what reports from the Brady camp are saying. All the talk about Brady taking a game is from the NFL. This thing is going to last a long ass time. I don't see this ending any time soon. I'm starting to believe the reports saying that regardless of the outcome this is going to appeals.

I think it might be one, but I agree on Kessler. I wish the full transcripts of the court hearings were available to pore through.

I love that the judge asked how many games were for deflation and how many for lack of cooperation. Also what would be the penalty for the next person who deflated but cooperated. Great questions. Would love to hear Goodell answer that.

Does anyone know what 'cumulative' means in this legal sense? Seems key based on the reporting. From what I can gather it might mean something like redundant or repetitive (i.e. repeating past finding)?
 
People need to realize that this has nothing to do with the Patriots or Brady, it's all about Goodell getting the power to get whatever he wants, to whoever he wants, whenever he wants.

Which was given to him in the last CBA. It seems to stupid; They signed off on it and then were complaining about it within months and it's a long time before they will get to bargain it out of their deal.

The CBA spells out specific punishments for every infraction. This suspension goes above and beyond anything in that document. Therefore, the legal system is on Brady's side.

Have you noticed how often players fight a suspension and then it's reduced? That's because Goodell went further than the CBA allows. He doesn't have unlimited power, though if the NFL wins this case, that sets a terrible precedent.

No it is not. Why do people keep saying this? If it were, the court would not hear the case.

The appeal is on the process. Because the NFL filed asking for validation of it's process, the judge is doing just that. Unfortunately for the NFL, the judge (rightfully) is considering the whole process which also includes steps before Article 48(42?).

He can rule there should never have been an arbitration process to begin with, thus it is not a fair process. This is how weaker unions can still win over stronger (unfairly agreed upon) CBA's. If this was not the case, you would have big stores (See large grocery stores) hold out against every union within it's company until the people become so desperate for money that they agree to anything.

He doesn't have unlimited power, though if the NFL wins this case, that sets a terrible precedent.
He does have unlimited arrogance though.

I don't think so. This has a more of a movie plot of how much Goodell has been corrupted by power(might as well have the one ring). Without Hind sight I don't think anyone honestly saw him going this over the top.

He saw an opportunity to fix his reputation, and prove he's by the books. People questioned his credibility after TMZ outted him for ray rice, his handling of Adrian Peterson and various other issues, etc. On top of that it worked by dispelling the whole kraft as co-comissioner narrative. Instead and it only further solidified the guy as a clueless, inconsistent figure head for the league. He's so committed to that wells report, an why not? He looks like a moron either way so why not go down swinging.

I don't think you guys understand...Goodell already has that power. There's no DUI punishment coded into the CBA...but often times people are suspended a game. The Steelers players were fined and suspended multiple times for hitting people "hard", more or less.

4 games for smoking substances that are legal in multiple states.

Mind you, the Browner "PED" suspension was that he missed taking a drug test..when he wasn't in the NFL, he was playing in the CFL. The codified rules apply to you even when you aren't in the NFL...cuz...this is what happens when you have monopolies on an entire industry.

you mean doing what was given to him in the CBA signed by the Owners and the NFLPA?

Patriots quarterback Tom Brady has no plans to break.

Brady is not preparing to accept a suspension as part of a settlement with the NFL, according to a source who refuted any reports suggesting otherwise. Reports have surfaced today indicating Brady is ready to accept a suspension for his role in Deflategate, but that is false.

Judge Richard Berman held his second official meeting with Brady's team and the NFL today in New York City while Brady practiced with the Pats in West Virginia. The two sides initially met last week with Berman, and they talked again yesterday.

However, Brady isn't folding right now.
