But if you're trained in tactics that include a chokehold to render someone unconscious, you are taught to let go as soon as they stop moving and unconscious. You don't keep holding on for minutes after they're unconscious. That's where manslaughter or criminal negligence comes into play. Penny should have released when the man was no longer a threat.

I'd say next to zero chance at a hung jury. Juries are usually very good at doing their duty. And there's jury selection. The only way I'd see if there's a hung jury is if the prosecution fails to prove he's the guy who did it or the defense can argue insanity--which is incredibly hard to prove and would have no chance in this case given the amount of planning required.
