CENTENNIAL - After just 13 hours of deliberations, the jury in the Aurora theater shooting trial determined a verdict.

Jurors received the case Tuesday evening after closing arguments by prosecutors and the defense over whether gunman James Holmes was legally insane at the time of the July 2012 attack. Holmes shot and killed 12 people and injured at least 70 others during the massacre at the Aurora movie theater during the premiere of The Dark Knight Rises.

The jury started deliberating the case on Wednesday after hearing nearly three months of testimony, including heartbreaking and sometimes gruesome survival stories. The twelve-member jury included nine women and three men. Two of the jury members have close ties to the 1999 Columbine shooting.

At 1:23 p.m. on Thursday, public information officer for the Colorado Judicial Branch Rob McCallum tweeted the jury had reached a verdict and that it would be read at 4:15 p.m.

There are 24 murder counts for 12 victims. Each murder is being charged twice, under two different legal theories: "with deliberation" and "extreme indifference."

If Holmes is convicted, the trial will enter a sentencing phase in which the jury must decide between life in prison or the death penalty.

I was remember when I learned of the killings, it felt like a punch in the gut.

After Columbine, it's unbelievable to see a mass shooting happen so close to home again.
 
I realized that I don't really understand what constitutes insanity and I'm probably confusing it with incompetence. Lots of people here are talking about how his planning means he knew what he was doing. I think he did but I'm admitting I don't understand what his behavior means to his plea. I mean, what else other than insanity were they going to plead with?

I live in Aurora about 2 miles from the theater. There is going to lots of emotion in the neighborhood tonight.
 
Well Guilty for one, guilty for all I assume.

I need to read more about this case and what was presented for his insanity plea.

What? The defence was that he was insane, which his actions at the time do not substantiate. The way he carried out the massacre at the cinema, and the way he booby trapped his home, showed someone very calculating and aware of their actions. In other words, absolutely guilty of murder in the first. Not sure where mental healthcare comes into it.

is the death penalty a thing in Colorado? I'm not current on which states ban it and which don't.

We have the death penalty, but it is rarely used. Since the 70's we've only had 4 people on Death Row (5 if you count Holmes). Only one of those has been executed.

The other three are...

One man who killed 5 at a Chuck E Cheese in the 90s (killed ex-coworkers after place had closed)

Two men involved in the execution of two witnesses. They were to have testified against one of them. The shooter, and the one who ordered the execution from prison, were sentenced to death.

That all being said, Colorado currently has a spineless Governor who has "indefinitely delayed" the execution of the Chuck-e-Cheese shooter.. He doesn't want to deal with it. He won't commute the sentence to life in prison, he's just ignoring it until he's out of office. Even being for use of the Death Penalty in extreme cases, I would at least respect the guy if he had a moral objection and just commuted the sentence to life, but for him to just ignore it and pass the buck really pisses me off.

I mean if he goes to jail is there any chance he's getting any sort of treatment? He's been found guilty so the insanity defense didn't work, but have they done psychological examinations and stuff too? I'm sure they have and I just don't remember.

I just don't know that a person is 100% sane and does this. On some level he's ill. Maybe not ill enough to be excused for this, but if there is anything wrong with him I hope he gets treated. I don't even know how that would work.
