That's the all purpose of the thing so it's possible, but like saif just above, it's up to the developers. You code what you want, you just have the interface and button layout, you do whatever you want. It just like the 3D slider on the 3DS. I think developers can very well use it for something entierely unrelated to the 3D effect. Vice-versa, look at the d-pad functionnality in SM3DLand: pop-in or pop-out 3D. Programmers can switch off the 3D by pushing start or A if they want!
Now, for the Upad: A 3 way switch can be the norm:
- Mode normal: Action (1) on TV, action/menus (2) on Upad;
- Switch mode A: Action (1) on Upad, action/menus (2) on TV;
- Switch mode B: Action (1) on background on Upad; action/menus (2) in a popup on the Upad (just like the one player mode in Four Swords Adventures); Dashboard or nothing on TV.
Push the switch again and you're back to "mode normal".

He still has to fix his perception as a bitter hater who does unprofessional, trolling, childish tweets. He did that to himself, and as we all know about perceptions, he and he alone is solely responsible for changing it.
I think my favorite part about all this is that it started with a potential customer asking him about a product that he would like to purchase, and instead of putting aside past differences and swallowing a little pride and finding a way to serve a potential market , he tells said customer to go hang and every thing that the customer might like is shit. That's horrible business practice.

For Virtual Console titles, it's more than likely that they'll be playable on the controller. There's no reason to believe that won't be the case.
For Wii U titles, Nintendo said last E3 that it's going to be up to developers how they use the controller. They're not going to make demands on how it should be used - if at all. For their 1st/2nd party content, I gotta think they'll let you play with the controller alone. 3rd parties can do whatever works for them.

Someone should send him a Twitter with source that tells what the Wii attach ratio is.That's not helping his perception of being uninformed. The Wii does not have an "exceptionally low" attach rate. That's a forum myth that isn't even close to being the case.
If he wanted to have a nuanced opinion, Twitter isn't the place for it. If his tweets came across as dickish and trollish, then he either meant it that way or allowed people to think that way. And you know what they say about first impressions.

1. There were actually two Wii U/3DS games he had heard of; one was Assassin's Creed III, although he hasn't been able to confirm a 3DS version ever since the Wii U version was announced.
2.The other one is more important and he has validated its existence but cannot reveal it due to an NDA. No hint but "good times are coming."
