This is where the confusion/contention seems to arise though. I don't think it's commonly taken that something that's first party published is a "third party exclusive" regardless of IP ownership. I think that most would take Heavy Rain, Sunset Overdrive, Ryse, The Wonderful 101, Lego City Undercover as first-party games based on their being published by the respective first-party vendors.it really depends on who owns the sunset overdrive ip. looking at the copyright, the sunset overdrive name is copyrighted and trademarked under insomniac games. you can look up the same info for perfect dark and find the copyright and trademark is actually under rare, while the copyright and trademark for donkey kong 64 is actually nintendo.

I do. They needed funding and Microsoft stepped in. Sony refused. If that didn't happen, the game wouldn't have been released at all. So it was going to be an Xbox exclusive or nothing.

The deal was MS would have timed exclusivity for their lending a hand with the project. Then they threw more money at EA beyond the initial deal to make sure it never goes to PS3 or PS4, and even Respawn had no idea that it happened. Do I need to post Vince's tweet?
First Party: Published and funded by the console maker. Doesn't matter if they own the IP or studio. Eg. Halo and Uncharted (IP and Studio owned), Quantum Break and The Order (IP owned, not the studio), Sunset Overdrive and Bayonetta 2 (IP and studio not owned).
Second Party: Console Maker distributes game, but does not fund it*. Eg. Dance Central, Ninja Gaiden 2.
Third Party: Published by a company other than the console maker. Eg. Titanfall, Bioshock.

no its not. Because they dont necessarily own assets or content, only the IP and publishing rights. Otherwise games like Mass effect would never have been able to go 3rd party.
Wrong!! It DOES NOT matter who funded the game or who owns the IP, as long as a platform-holder published game is developed by a 3rd-party developer, it's a 2nd-party game.
