August has probably been the worst month in many years with everything going on. At least I hope something good comes out of this. But I severely doubt it.

Yeah at the absolute very least it's insane to be fired for falsifying police reports and then being later hired as a police chief. But of course it doesn't end there. Because if you're hired under those circumstances, you owe someone something.
 
Now the protests have subsided, the world has moved on. Fact is civil disobedience can help get results.


Sell them for scrap then. Or better yet don't buy expensive toys for the military in the first place if they're going to chuck 'em after a few years and use the money saved on something worthwhile.

No Incident Report? Then Where’s Use of Force Report? More Violations from Ferguson

Everyone who is paying attention to the incident in which Mike Brown was gunned down in the streets of Ferguson, Missouri by Officer Darren Wilson is aware that there is no actual “Incident Report” in existence. Well, more specifically, a week after the ACLU requested the report and was told that there was a report but it was being withheld because it was exempt from the Sunshine Law, they produced “an” Incident Report that had no useful information in it.

What we now can state firmly in addition to this is that Ferguson Police also do not have a Use of Force Report that their policies required to be produced – not by Officer Wilson but by the Watch Commander on duty that day.

Ferguson is deliberately violating both the laws and its own policies to prevent any information from being produced and made public that could be used to hold Officer Wilson to account for his actions. This is a serious problem of cover up, abuse of authority, and contempt of the law by both the Ferguson and St. Louis County Police Departments. Given the evidence there is ample reason for the public to have little, or no, confidence or trust in either of these agencies.

If anything positive may come from the tragedy of this event, perhaps it may be a wider knowledge and understading in the public of their right to obtain public records from their public agencies and officials. And a recognition of the immense power these laws – if respected by officials and enforced under the law – provide to citizens seeking to hold public officials and agencies to account under those same laws they are entrusted to enforce.

For even the response that there is no record as requested provides evidence. It is an answer to the question, in this case, did the Ferguson Police Department, including the Chief of Police , follow the law and the Department’s policies?

The answer is now clear.

The Chief, the Watch Commander, others in the department, and Officer Wilson do not believe they are subject to the law.

They have, at best, some different set of laws or standard of law that they believe they must obey – just not the laws on the books. Not even their own Departmental policies are binding according to their actions.

This leaves us without any knowledge of just what occurred on the day of the fatal shooting of Mike Brown. It suspiciously allows Officer Wilson, and the rest of the Ferguson Police Department, to wait until all the evidence against Wilson is discovered and collected, and afterwards to write reports that will neatly fit the evidence. Rather than to have those required reports serve in the evidentiary capacity that they were intended.

But the absence of records and reports does not leave us entirely in the dark.

We have proof of one thing: the entire department (actually two departments) are actively defying the law and their policies to cover-up the facts of what Officer Wilson did that day. And to deny the right of the public to obtain those facts in the records the police are required to keep.

In this case, therefore, there is ample reason – in fact actual evidence – for the public to have no faith or confidence in anything these Departments, their officials, or the officers employed therein do or say. And certainly there is no reason to trust that they can honestly and faithfully participate in the process inquiring into and investigating the shooting by Officer Wilson.

So, I've been on vacation, but saw a news video of two cops trying to break into a black families SUV? One of the people here said it was Ferguson?

Was it or were they just uninformed lookie lou's?
 
FUCKING WHAT.

I only saw a bit of the video (of two white cops and one of them using their nightstick on apparently the window), but they were then showing a clip of interviewing the (all black) family.

I then asked people and they said Ferguson.

I don't know anything else.

It didn't look like Ferguson in the brief video bits I saw. That's why I'm asking. I'm not trying to incite anger or concern troll.

Pretty much how I took it. No idea how the author of that link for took it otherwise. Should be the original blogger focused with scrutiny, not the post itself.

There are 90 municipalities in St. Louis County, and more in the surrounding counties. All but a few have their own police force, mayor, city manager, and town council, and 81 have their own municipal court. To put that into perspective, consider Jackson County, Missouri, which surrounds Kansas City. It is geographically larger than St. Louis County and has about two-thirds the population. Yet Jackson County has just 19 municipalities, and just 15 municipal courts — less than a quarter of municipalities and courts in St. Louis County.

Some of the towns in St. Louis County can derive 40 percent or more of their annual revenue from the petty fines and fees collected by their municipal courts...
...In a white paper released last month (PDF), the ArchCity Defenders found a large group of people outside the courthouse in Bel-Ridge who had been fined for not subscribing to the town’s only approved garbage collection service. They hadn’t been fined for having trash on their property, only for not paying for the only legal method the town designated for disposing of trash.

According to the St. Louis Post-Dispatch, blacks make up less than eight percent of the Florissant police force. The judge and both prosecutors are white. In nearly all the towns in St. Louis County, the prosecutors and judges in these courts are part-time positions, and are not elected, but appointed by the mayor, town council, or city manager. According to a recent white paper published by the ArchCity Defenders, the chief prosecutor in Florissant Municipal Court makes $56,060 per year. It’s a position that requires him to work 12 court sessions per year, at about three hours per session. The Florissant prosecutor is Ronald Brockmeyer, who also has a criminal defense practice in St. Charles County, and who is also the chief municipal prosecutor for the towns of Vinita Park and Dellwood. He is also the judge – yes, the judge — in both Ferguson and Breckenridge Hills. Brockmeyer isn’t alone: Several other attorneys serve as prosecutor in one town and judge in another. And at least one St. Louis County assistant district attorney is also a municipal court judge.

“I had a felony criminal case in state court a few weeks ago,” says a local defense attorney, who asked not to be quoted by name. “Sometimes criminal cases can get contentious. You have to do everything you can to defend your client, and sometime your interaction with a prosecutor can get combative. A few days later, I was representing a client who had a few warrants in a municipal court where the same prosecutor I was just battling with is now the judge. Is my client is going to get a fair hearing? You hope so. But it sure looks like a conflict to me.”

That's how I took it as well. If the Post was trying to "slime" Mike Brown, they would have requested the information without announcing it. Then, if they came up empty they never would have even mentioned the request.

Where are the white residents of Ferguson, Missouri ? people brandishing signs reading "Justice for Officer Jay Nixon"? There may be a need to bring whites in from other locations, as the blacks have done. Whatever it takes, but white people had better begin to show force and fight back against the ongoing destruction of all that has been achieved in the racial arena in America. Gains made over many decades by many Americans, both black and white. Conservative blacks cannot fight this fight for you. You must fight it.

Yes, I am black, descendant of slaves, reared under Jim Crow segregation, and all that minutiae, but I am also extremely tired of the "somebody else is the cause of my problems" mentality engrossing too many black people. A mentality that elitists Barack Obama and Eric Holder have preyed upon throughout their miserable careers.

Understand this, folks, if you glean nothing else from the madness going on in Missouri. Eric Holder is in Ferguson, at the behest of Obama, for the express purpose of subverting justice. That is what these two despicable men do ? subvert justice, so as to perpetuate divisiveness and hatred among blacks and whites. I am not a psychologist, but a good reader of human nature, and I detect that Holder's twisted ego is stroked mightily by all those non-elite blacks fawning over his presence. The "activist" Attorney General is their savior; he will see that the white man suffers, guilty or not.

I recently caught a glimpse of Holder on TV working a group of blacks as if he were one of them. He is not. He is elite and privileged, and these black masses mean nothing to him (or to Obama), other than in the furtherance of a leftist agenda. If these agitators can be coaxed to the poll booths, they will vote Democrat. Never mind that Obama and the Democrats are the reason for much of their economic and social woes.

I am becoming fed-up with the response (or lack thereof) that so many whites display in face of the criminal behavior of so many blacks. I have had it up to my brow with "political correctness" and "white guilt." I am even becoming increasingly irritated by conservative spokespeople, such as Rush Limbaugh, who, although in satire, displays a defeatist attitude toward black racism.

Limbaugh will often say "You cannot say that..." or "We will never be absolved of guilt...," in what he characterizes as satire. I understand what he is doing, but I sense that as a white person, he may use this tactic out of fear. Genuine fear of taking on the racists. Or perhaps fear that without satire he might provoke real action on the part of his millions of listeners, and he does not want that responsibility. I am unclear about his motives, but I do know that it is time for oppositional clarity, no satire.

Circumstances are much more dire since Obama was foolishly placed into the Presidency and Congress foolishly accepted his nomination of Eric Holder for Attorney General. These two men are leading the destruction of this nation, and that reality is dead serious. All conservative spokespeople and people in positions of leadership should be rallying Americans to fight these men.

When blacks begin tearing down a city (any city), whites should be supportive of the police (in their full, military hand-me-down gear), encouraging them to overrun, apprehend, and detain everybody on the street. And for those committing crimes, treat them as criminals and stop the crime. If that means killing people, so be it. That is the way the police would treat a mob of marauding whites. Safety of the police force should be paramount.

Ignoring the bad-asses and criminals (because of perceived grievances) has done nothing but terrorize decent citizens of all races in large inner cities. That lunacy must stop.

Policing is a dangerous occupation and given the police officer's task of confronting crime and protecting the rest of us from criminals, sometimes violence and killing is necessary. I will give any cop the benefit of the doubt over any suspected crook, whatever his color, until I am given evidence to think otherwise.

It behooves the rest of America to do the same. Or, I say police should refuse to work in areas where they are put upon by small-minded politicos, such as the Democrat governor of Missouri, Jay Nixon, and race-mongering law officials like Eric Holder. Police officers have unions; they should demand that bosses support the boycotting of hell-holes such as Ferguson, if they are to be demeaned.

One final note, ignore the libertarian scare mongering about "militarized police." Libertarians tend to be elites who live nowhere near inner-city communities. They are more likely to be in gated facilities or areas so financially set that crime is something they experience only in the news. They have the luxury of whining about how the police are equipped; the rest of us just want them equipped at their best, and armed to the teeth.

One of those pending warrants was for “Jack” (he asked that I not use his real name), a black man who looked to be in his 60s whom I met briefly at the Cool Valley courthouse. I noticed Jack as he was chatting through a teller’s window with the court clerk. He was getting increasingly frustrated. I followed him outside and asked why he had been in court. He said he had recently been stopped by a police officer. He hadn’t been issued a citation for the stop, but a search of his name apparently showed a warrant stemming from a 20-year-old speeding ticket. With late fees and added fines, prosecutors said he now owed $615.

But he said he was angry because no one could show him the original ticket. They could only point to the warrant. He believes it was a mistake, and wondered why the warrant wouldn’t have shown up the other times he’s been stopped over the last 20 years. But the court officers had no time to argue with him. They handed him a piece of paper showing what he owes, with instructions for his payment plan. He is to come back to court each month and pay $50 until the full amount is paid off. If he misses a month, they’ll put out another warrant for his arrest.

I showed the form the clerk gave Jack to several local attorneys. Most agreed that a good lawyer could probably get the warrant cleared and the fine dismissed. It’s doubtful, for example, that the officer who issued the ticket is still around, and if he is, that he’d remember the ticket. But Jack (he asked that I not use his real name) didn’t know any of that. One attorney attempted to look up the Jack’s record to find the warrant, but not all the municipalities use the designated legal databases. Cool Valley is apparently one of those that doesn’t.

“I’ve asked prosecutors for a client’s file and they’ve flat turned me down,” said one local attorney. “They’ll say ‘Here’s a list of his warrants, but we can’t show them to you. Just trust us.’ Or they’ll just staple a blank form to a manilla envelope, write my client’s name on it, and call that his ‘file.’ They’re giving me the runaround, and I’m an attorney. So you can imagine what happens when people try to work within the system by themselves.”

It's a great book. Hard to read if you aren't prepared for the Balko.

I'm joking a bit about the link, Balko's an open libertarian so he has anti-national health care, EPA, pro-gun, etc. views but the people who run SHAME really hate when he gets attention for his coverage of police abuse because they're afraid it'll be the hit that gets otherwise good progressives addicted to libertarianism.

In other words, Balko is the furthest thing from a professional reporter. Apparently fact-checking a reporter is something only done when we disagree with the report; otherwise, it's unseemly.

The problem of course is that a right-wing GOP shill like Balko is earning the credibility and respect of many on the left, who aren't even bothering to question why a Koch-funded PR operative has taken such an interest in police militarization, and what their political goal is in doing so.
 
So I hadn't caught up in this thread for awhile due to summer exams and other news issues around the world, but wow at the new developments. Cannot believe at the amount of corruption and number of violations committed by the police force and its benefactors.

It's one of those situations where we knew it was bad, we just didn't know the details, and it's worse than we thought.

And none of it would have been exposed so clearly because nobody would have really looked into it had people not protested and "rioted" almost a month ago.

St Louis Post Dispatch is considered a more liberal leaning paper so they actually were doing this because some consertative blog had "sources" that said he had a felony record as a juvinillle so they did a sunshine law request to get the information and what do you know he has a clean record when it comes to felonies

I don't know how they go about doing it, but Missouri needs to find some way to force these communities to consolidate. It's such a waste of resources for each of thee small towns to have a municipal government and infrastructure.
