As a general rule, it is against company policy to use work time to engage in sexual activity on work premises, and to talk about doing same.

I mean, maybe your company is different. But if you think it is, you should probably try doing it first and see what happens, because I don't think it is.

He's the boss, he has the power to decide whether it's a forgivable offense or not. Believe it or not, some people care more about resolving individual issues rather than just throwing the book at every offense.

As a boss and therefore someone in the position of responsibility or trust for the company, he has an obligation to handle the situation correctly. Sure he can decide to keep it to himself. But if it ever comes up again to another employee and it is discovered the boss chose not to follow up on this original case, he can get into trouble too. Why? Because the company is now exposed to unneeded liability.

There's a lot of things that aren't in the employee rule book, murder isn't in an employee rule book, maybe a company doesn't have an employee rule book but it's common sense.
