The lawyer's not risking anything. It's a win/win for lawyers on one side or the other of a high profile case depending on what it is.
Court of law says innocent till proven guilty. Civil court means lower threshold of burden of proof. Vibes even, if you get the wrong kind of jury and/or judge. Court of public opinion will do whatever it does.
