Aren't Nintendo shipping the consoles without any foam between the screens? If that's the case wouldn't all the screens be fucked out of the box?
I can say that my 3DS XL don't touch. I've walked with it in my pocket and such. There is clearly a gap. They put the rubber stops in the right spot.

I'm getting screen protectors. I noticed the other day from very light usage, mostly none at all, on the part where the bottom screen matches with the top, when you have the screen off, under really intense lighting, and a bit of moving around to capture the right lighting, there are very tiny, minuscule scratches on my unit, and before it gets any worse, the screen protectors are coming in... And you know what, I honestly don't think it's just exclusive to my system, how would that even make sense? Aren't they all manufactured the same? Except for like a dead pixel and screen temps, scratches happen because of the way the system closes itself, and I'm pretty positive every screen closes itself the same way unless you've got some kind of broken hinge or something. Which I doubt is the case, because Nintendo even put rubber pads on the top screen, but I'm starting to feel like they didn't even bother testing it. Nintendo need to get this shit straightened out, because until now, I have not had to do this for any Nintendo handheld.

I went without the cloth for 2 days and noticed two tiny dots on the right side of the upper screen. My top screen is flawless. I've had mine since Sunday morning, been playing the shit out of it since. I've taken it out to coffee, to stores, on errands. Nothing. Not a single mark on the top screen.
I'm not saying it can't happen, it probably can, but maybe your nit is defective? Maybe the scratches were there from production? Call Nintendo and set up a repair. Get that unit replaced. You keep saying its not a big deal to you, but you keep trumpeting this thing that you say isn't a big deal...which means it is a big deal to you: fix it.

Someone asked for pictures of the free Universal hardcase that Bestbuy is including with purchase of the XL. It's actually not a bad case and very sturdy. You can't beat free.

No it hasn't, a few anecdotal cases does not "prove" that it is an easily encountered issue, just that it can be an issue.
Light use... you mean like how I constantly carry mine in my back pocket, sometimes going up stairs even (gasp!)
Again, I never said it wasn't an issue, just that when you look at the very small number of people complaining compared to the millions of units out in the world now you have to realize it is not wide spread. Wide spread is OG Xbox 360's red ringing, or first gen PSP's with dead pixels, from what I've seen this issue does not fall under that category. It is definitely a very real and shitty issue though.

Mine could have been sitting piled up under a bunch of other boxes and got pushed too tightly, and it's worth noting that it's only on the right side. Have any other people reporting this issue said it's on the right side only? Because then that would be an interesting correlation, some guy before me said it was on the right, but I don't know about all of the rest...
That's my whole point dude, the saying is "vocal minority" because it's usually the people with issues that are the loudest, the people without issues are quiet cause they have nothing to complain about.
I again want to stress that I've seen pictures and I fully believe people when they say they've gotten the issue, I just do not believe that it is in any way as bad as some people make it out to be. And to me, the bottom line is if it is an actual issue on your 3DS then hey, Nintendo will fix it. That may not be enough for some but at least it's something.

The 3D is done well on the XL but I never use it anyway. It doesn't add anything to the game (3D Land is the exception) and gets very annoying if you move your head or the system even just a tiny bit. Nothing between the screen on mine and so far I have see no indication of the screens being scratches.
