Tyrone Smith knew how to use his fists. Around his Miami Gardens neighborhood, the 19-year-old was known as the “Karate Kid” because he taught local children self defense and how to stand up to bullies.

But when Smith felt insulted and began shouting at neighbor Jason Kinsey, the confrontation did not end in fisticuffs. Instead, Kinsey, 20, fatally shot the unarmed teen — claiming he was defending himself against the martial arts expert.

A judge agreed. Miami-Dade Circuit Judge William Thomas last month ruled Kinsey indeed acted in self-defense, saying prosecutors are “discounting the enormity of Smith’s rage and the level of physical skill that Smith possessed as compared to Kinsey.”

The legal fight, however, is far from over. The State Attorney’s Office is now appealing the judge’s decision to dismiss the second-degree murder charge.

For prosecutors and Smith’s family, the case encapsulates all that is wrong with Florida’s controversial Stand Your Ground law: the teen was unarmed, challenging Kinsey to an “old-school” fistfight only after being repeatedly provoked.

Really depends on the circumstances. If someone is beating on you in blind rage, doing a lot of bodily harm, then shooting the attacker is fair game if you're scared for your life. If it's a simple "duel", then yeah, that's shitty.

Without knowing the absolute truth (and the article tells two different stories) it's hard to pass judgment.

Edit: Well, nevermind. I thought it was strange when the article just ended, but apparently it just didn't finish loading. Gun dude is at fault, what horse crap.

If you listen to the video ... if you can tolerate it .... the dude who got shot is definitely the aggressor.

Doesn't excuse shooting him ... but still.

I, for one, would not just stand around while someone in much better shape and experienced than me beats my ass.

Lots of people die from fist fights. All it takes is one punch in the right spot and you can die. Not to mention the risks of slamming your head into the pavement or curb, etc once you're knocked out.

I would have ran since I don't own a gun. If I had a gun, I would have threatened him with it without thinking twice. If he kept coming at me, maybe I would have shot him, I don't know. It certainly isn't anyone's duty to protect someone by accepting a beating from that person.

This sucks but I do think they're right to a degree. Pretty sure my sensei had to get registered or something because he's a black belt and could be lethal if provoked.

I could be wrong, but I'm pretty sure that's an urban legend/joke.

edit: I'm at work and can't watch the video. Does he shoot after they begin fighting, or were they just talking shit and about to fight, and then he shoots?

A fight never took place. The Shooter stayed on his property and the man who was shot never stepped foot on the Shooters property.

Luckily for you, the chances of you accidentally shooting yourself with your own gun, or being killed by your toddler who found your gun, or being shot by a senile relative are LITERALLY geometrically higher than you being killed by dim mak from a karate champ.

Uh the karate guy charged him with his gun drawn. If I say I don't want to fight, and then you say "no put the gun down let's settle this old school" fuck your Bruce lee ass. If you get close to me I would have done the same thing.

Neighbor said the man who was killed took two steps. The Shooter, who admitted that he opened the gate to his property "to entice" the victim, is the only one claiming the man charged.

And it wasn't much of charge considering the man fell to the sidewalk and never stepped foot on the shooters property.

...Smith eventually walked away. Moments later, Kinsey said, he called a friend, who brought him a handgun, then opened the house’s gate “to entice Smith to enter his property.”

...

Witnesses differed on exactly what happened next. One neighbor said Smith just had his hands balled up and took two steps before the gunfire erupted. But Kinsey testified that Smith — shirtless, and brandishing no weapon — charged at him.

Kinsey fired two bullets, felling him at a range of just a few feet. His body fell on the sidewalk, never having been on the property.

The fact that a fight never took place is irrelevant. You don't wait until someone punches you in the face to protect yourself.

The video doesn't show the final confrontation. According to the article, Smith left after what's shown in the video and then came back and either a) had his hands balled up and took two steps or b) charged at Kinsey.

I don't know, some guys yells at me for 6 minutes, calling me bitch ass this and puss ass that, threatening to spread my "blood all over the street," leaves, comes back and then takes two steps toward me with balled fists... yeah, I might shoot that guy if I had a gun on me
and if I knew how to use it.

I don't know what really happened after the video, but based on the video it's pretty clear that the guy who got killed was far and away the one causing the trouble and being the aggressor here. He's literally screaming obscenities and talking about fucking this guy up for for the full 6 minutes of the video and the guy in the yard hardly says anything. Just walk away, that's all it would have taken for him to still be alive. Sad and completely unavoidable.

So.. going inside your house after the man walked away initially isn't an option?

If The Shooter didn't want to force a confrontation he wouldn't have called a friend to bring him a gun and then opened the gate to his property "to entice" the other man to enter it. The two men were neighbors. The shooter knew full well that the other man would be back multiple times because they live near each other.
