To be honest I thought it looked far worse in real time, seemed like Torres came in really fast and headbutted him (accidentally, but dangerous play).
Was only in the replay it cleared things up.
I think its the other way round. If the referee saw it and deemed no action worthy, they can't do anything about it... but if he missed it in his post match report they can look at it.
