How does that happen?

There are two possibilities

Either she literally threatened to sue everybody who copypasted what Dave said on their own site (aka lordsofpain, 411, rajah, wrestlezone, etc) but not Dave because don't shoot the correct messenger (in the process accidentally proving him correct even more than DA already having done that)

Or she thinks him having sent emails warning her exactly what was happening with the station and her not responding will lead to anything in court other than her getting immediately laughed out of court

Another funny thing is the fact that was revealed on Sunday morning's Wrestling Observer podcast... That TNA/Dixie sent this email around to all these various outlets with the statement threatening legal action, but didn't actually send that statement to Dave Meltzer or Bryan Alvarez.

So if it wasn't obvious enough that this threat is all bluster, it should be crystal clear now.

His issues are due to a very experimental jaw reconstruction surgery that he agreed to a while ago. There was a low success rate and Heenan knew that when trying it. He was willing to try anything to speak normally again. As you can see, the surgery failed.
