My guess is they either close and then deal with CMA, or agree to extend until CMA decision becomes final one way or the other.

At this point I'm expecting them to close the deal with CMA approval in some fashion. It just seems doubtful they would have fought the FTC if they cared about CMA or didn't have some inroad to getting that decision changed.

Well now I want to see what happens in terms of Microsoft closing over the CMA's head.

The FTC might have scored a massive own goal here in terms of bringing this injunction forward rather than letting the CMA process play out first.

Unfortunately, but I suspect we're about to get a flood of people who don't understand that. The CAT appeal is still outside the deal deadline. One that has yet, after months, to be renegotiated with only a week remaining before the deal terminates. So now we wait the week out to see if there is any movement there.

They did give the CMA more ammo on public record for the cloud scenario.

The judge herself went on record saying consoles will cease to exist and cloud/subs will be the future based on information provided by both the FTC and MS.

The issue now becomes the fact that they are flying completely solo.
 
Really didn't know which way this one was gonna go... onto the CMA then. Microsoft prob really are gonna shock the world and close this thing huh? Sony better hurry up and go refresh that 10 year deal MS is offering them... :P But maybe not though, who knows how this is gonna play out?

The hearing process has been expedited specifically because of the deadline.

It would actually be prejudicial to MS to not shorten it, what's the point of a injunction denial that doesn't actually deny the injunction in reality.

This will however encourage ABK to extend to contract. If both FTC and CMA had successfully blocked it, they would not be as open to taking that risk as they would be now.

The fact that the FTC moved for the injunction so quickly indicates that they thought MS was close to closing imo.
 
Lol. I knew something was up when my ATVI stock jumped $4. Thank you MS.

For all the Xbox haters acting like big shots and lawyers, relax. You still are getting COD on PlayStation. You are still getting Diablo. You are still getting Tony Hawk.

The only difference is that a few years from now when all the Activision/Sony partnerships have contractually ended, Xbox will be getting the promos first. Just like how Sony has been getting the deals for 10 years.

The whole "oh they only have 5 more days to 'win" talking point is weird, ACTV and MS can always renegotiate and extend the term. There was nothing preventing that.

I find that doubtful.

I'm not a UK guy so maybe things are different. But in the US I would expect the CMA appeal arguments to be based on evidence that CMA analyzed before their decision. Plus, I doubt the CMA considers or could prove that the judge is an expert on this. On top of that, if they disagreed with her ultimate analysis they would be saying she's wrong about everything expect one thing, which isn't a great look.

No it's not because both ABK and MS told the judge that this deal will be dead if they don't close it before July 18.
