I wonder if they can even go back to ATVI shareholders, now - the more I think about it.

At the point when the merger has failed in July, ATVI and Microsoft would be independent again, AFAIK, so the appeal process would be gone - because how do you appeal something without the other party? - and the stipulation they then can't try again for 10years would be in effect surely?

So the question would then be: does the renegotiating the deal and having shareholders agree, have to happen before the July date? If so, how does Microsoft do that without falling foul of the terms that require both to make "best efforts"? Telling ATVI you need to renegotiate would surely making the $3B penalty immediately payable and deal over if ATVI wanted, resulting in a major risk of no obligation for ATVI to consider a renegotiated extension, and again potentially kill the CMA appeal in an instant and rolling over to a 10year block to try again - ruling out any dialogue between Microsoft and ATVI over an acquisition do-over.

Maybe the whole thing isn't so strict and there are pre-defined mechanisms for the renegotiation in the deal terms.
This is a very good point! Nobody thought of this before.

Not sure what the actual legal ramifications are, but this is worth talking about.

1. Doesn't matter, they're both PR statements until games get announced for all platforms. Bungie's blog statement and Phil's promise of indefinite CoD multi-platform are exactly the same amount of valid.
2. Your timeline is skewed, the "as long as there is a playstation" is the latest statement as of November. Not the first thing committed.

Yes, for their flagship series on two most popular consoles of all time I say 8.4 is very bad, if by next year Zelda has sold 8.4 million we will all call it a flop.

FWIW, it took Breath of the Wild around 1.5 years to reach over 10 million copies sold. You can break that down into an average where it's around 9.375 million for the first 15 months.

Yes that's higher than HFW's first 15 months...it's not that much higher, honestly. And very impressive for HFW considering it's part of a much younger IP than Zelda.

I do understand the points about Nintendo's games costing less to develop, market, and maintaining their price longer than Sony (and really, almost everyone else)'s games. But I doubt TotK is going to do Elden Ring numbers within a year or 15 months post-launch.

Your logic that HFW is a flop is flawed because by that same logic Dead Space Remake, RE4 Remake, RE2 Remake, Metroid, even Elden Ring, could be considered failures when considering the actual sales vs. install base of the platforms they're available on.

They are talking about about not pulling existing games. Why does Brad Smith only mention Call of Duty and not the rest of the ABK portfolio to Nintendo here?

Because they specifically talked about bringing CoD to Nintendo, unlike they're talking about the multi-platform games people would expect to be on Xbox and PS ?

He also doesn't talk about Diablo IV on Nintendo, is that scandalous too ?


They offered a deal for COD until 2027.

Microsoft's plan was to buy Sony and discontinue Playstation and replace it with Xbox by 2027.

It would have worked too if the ABK acquisition was allowed to go through, then MS would have had an open invitation to buy anything else they wanted in the gaming industry.

I've quoted you at least 2 sources of them saying they'll keep other popular Acti/bliz franchises multi platform as well. The only reason CoD was written in documents is because that's what everyone was clamoring for with Sony making statements like their brand would literally cease to exist without CoD.

If you don't want to take their word for it then don't mind if I don't take Bungie's blog statement without any official announcements either.

Ok .. they revised the deal after receiving complaints about it not being good, to make it more favorable.

As of the latest what we know is that the franchise would have stayed indefinitely on PS consoles if the deal goes through.

I'm not seeing what the problem here is.

Again the deal to Nintendo and PlayStation was for COD only. We know the cloud companies have a deal for all ABK catalogue and 1st party MS games. Yes wait for the next Bungie Announcement, not a random twitter poster.

As for the latest we know COD will remain indefinitely on Xbox and Playstation thanks to the CMA. We're all winners.

If it's such a great deal, we will see ABK make all these deals now. ABK will make so much more money and they can hire the Xbox developers who will be able to run the latest COD on the Switch. ABK now with a roadmap to an extra 150m players

Phil has run the show at Xbox for almost 10 years. I for one can't wait to see how he spent these last 10 years developing a CoD alternative.

There was never a plan in motion for that.

They announced the deal too fast, without actually making an effort to come up with a plan.

Any competent person would have seen this from miles ago.
