I believe so for the main appeal.
This was CAT saying no to some kind of extension (delay tactic by CMA). CAT said something like they were "gaming the system" and that there hs been no material change to transaction to delay the appeal process further.
They'll just block and Microsoft will push on regardless... When does Canada, New Zealand and Australia make their decision?

Given how IGN has basically been in bed with them for years, to arrive to this point it's quite the sight.
Whatever happens Microsoft has truly shown its ugly face with these acquisitions.
 
That FTC guy argued like a fanboy, remember the "Sony is doing third party exclusives for Playstation users, they don't own anything to Xbox users"
 
They're currently speaking about how exclusives are not inherently a bad thing, but delineating between the scale, scope & intent between Sony's exclusivity deals and Microsoft's exclusivity goals driven by acquiring full 3P publishers completely.
 
All the FTC guy's gotta say is that Sony's 3P exclusivity deals still leave the option for direct competitors to bid for those deals and make independent business deals with the same 3P publishers, the way we're seeing with MS and Sega for example.

Microsoft making Zenimax & ABK content exclusive prevents Sony from being able to work in any capacity with those publishers for the future as long as Microsoft retains ownership of them, and Microsoft can act as the middleman in all those deals while "rigging" them to be beneficial for them regardless.
