I haven't actually listened to any of this prior to today, but the way this case has been framed - with Xbox just taking a L after L, just doesn't seem in line with what I am hearing now.
Burden of proof is pretty high when asking for preliminary injunction.

Nah he should be able to stand up for himself. Everyone they've brought in this case has been a wet blanket.

But that's the reality when the pay gap is so large between the public sector and private practice. What lawyer worth their salt is going to waste their time and qualification working at the FTC.

They have everything they need to make a proper case here but they are fumbling the bag because they lack the personality to see it through.

US courts aren't just about the facts/information, a lot of it is camaraderie that is built up over the course of a court case. They have done nothing to make her warm to them.
 
They'll not grant the injunction. Microsoft will close this deal and then pursue other targets, meanwhile, those who said Microsoft wouldn't do that(buy everyone out to the top) will be *surprised Pikachu face*
 
Judge seems like she's stuck in the 1980s re: video games. Did anyone tell her that the video game industry is bigger than movies, music, and tv all combined - and partly because it has all of those in it?

Yep. It's ultimately about who is the best storyteller. The facts & evidence are a part of it, but not as much as people think (or would be preferred).

This male lawyer speaking with a lack of confidence and constantly having to correct for misunderstandings (on his end) is simply not going to impress anyone.

There's going to be a percentage of people who will simply quit CoD, the judge is making a valid point. It's impossible to claim that 100% of CoD players will throw their Playstations in the garbage and buy an Xbox when CoD goes exclusive. But is it 50%? 10%? Who the fuck knows?

So it's very imprecise, that's the point the judge is making and the FTC guy is basically in shambles with this very simple point. Either refute it, explain it, or move on. There's a time limit on these closing statements.

You sound really giddy and happy about a near $3 trillion conglomerate buying out the industry to make up for their historic failures in that same industry.
 
Judge is being condescending to FTC on how they got the 20% departure numbers. FTC can't explain how Dr. Lee came up with the percentage.

Don't you see this as dangerous though?

It may very well happen. However, I think a healthy to and fro is the best situation for us, the customers. If Microsoft is allowed to do this, unchecked, nothing good will come from it.

They need to slow down, take this as a gut check and be more careful in the future.
 
If I were Microsoft I'd just make CoD timed exclusive, then actually exclusive on the next Xbox. Then just pay fines for lying under oath in a non-criminal case.
Timed Exclusive on a game that releases yearly? What length of time? like 3 weeks?

Ultimately this is a "home game" for Microsoft. This kind of situation/environment suits the way they operate down to the ground.

If the FTC want to see what needs to be done in order for them to have the power they want to have then they only need to look overseas (for example Microsoft more than met their match in dealing with the CMA - not least because the individuals there are indeed well paid so they can attract the necessary subject matter experts to run cases). But that would require a wholesale change in the process they have to adhere to and that isn't happening any time soon when the large companies in the US pretty much call the shots across the board.
