What they will do is say after 10 years or whenever before Sony decides to renegotiate- is say either pay up or you dont have it. Exactly the way it is now when Sony or MS timegate a game or negotiate a game to release on the console.

The literal same argument could be made for Bethesda games. We've been over this argument forever.

Commercial property and Employment can be ok.

Litigation/Corporate/Insolvency is just the pits.

I went in-house at the age of about 35. Best decision I ever made. Work is much more pedestrian and you farm out anything contentious to private companies, but at least I feel like a human again.

Sony could just as easily go to Behesda and say Heres 200million, make a game for us- The difference being MS gets to say No, or pay more. - Just like they are having to do with other publishers like SE.

Well I'm sure Sony missing their PC revenue targets by $50 million even with Bungie revenue accounted for, might give them some cause for concern.

Same with if there is any easy correlation between PC porting of marquee games and console releases seeing softer-than-expected sales due to the PC port windows being too close to each other. And in some cases, two years might be too close.

There's also the concept of adding value perception to the software and that can be best achieved by keeping the software within an ecosystem you have the most vertical control & integration with. For Sony that is PlayStation consoles. For Nintendo that is their systems and they're even better (more stubborn) at doing this than Sony are.

Careful bud. MS got exposed on a lot of shit through this. The FTC has dogshit lawyers who apparently don't know how to properly weave a narrative. No matter what the judge decides, there's still fallout from these revelations to deal with and they still have to contend with the CMA.
 
Feels like painful listening that the judge can't grasp that the Switch is a unicorn product strategy with old hardware, and that the gen 9 consoles are sold and launch to replace their predecessor because of the computational technology in them that leads to higher fidelity graphics.
 
They really should move on to subscription and cloud, the FTC is just not going to win on the console forefront.

I think they have a much better chance w/ the other 2. We could see things really turn around for them on that front.

You would have thought they would have the nous to follow the CMA's lead in this regard, but alas, they are incompetent.

What is frustrating is that the best jurisdictions for a vanilla competition claim are Europe and the UK. But both regulators have waived the underlying competition point and focussed on the cloud. This feels like a mistake.

Ahh sorry, I see what you mean I should have empathised "everybody".

We have data that 20% of PS5 users have an xbox. Meaning people who own a PS5 + xbox + gaming PC would be lower. So the majority of the market can't just play on their PC. So sure we can but everybody doesn't have every device. If everybody had a PC consoles would find it difficult to get any exclusives. Publishers would release just on PC.

Because the lawyers were clueless and didn't know for certain but there are surveys done for this case out there with that percentage.

You only forgot to mention the small difference of 10X in valuation between ABK and Bethesda..

Anyone that believe MS will take CoD of PS is delusional. This topic of CoD exclusivity can be revisited in about 5+ years when MS actually gets its teeth into the PS player base, by offering CoD on GP earlier than release date with extra maps, modes, guns just like Sony did when they had the marketing deal. Once enough gamers get leeched off Sony to GP will they potential reconsider making CoD exclusive, but that will take years and years.

Welcome to the FTC. There is a reason they are a joke and MS was never concerned. Best they did was expose MS's bullshit in a series of gotcha moments but had no fucking clue how to work with it.
