You are missing the point. They said they can't tell what the effect of a partial foreclosure can have in a shift on the market. It already exists, so you can see the shift.

Exclusivity of some content in COD is not the only reason why Sony and Microsoft have their respective positions in the market. It's just a part of that puzzle, not the whole puzzle.

So you would give your DIRECT competitor your specs and console so they can guess the price and compete against you?

I don't believe seeing a dev kit will give anyone an accurate idea of pricing.

It wouldn't matter much either, MS was hasty to remove Kinect and drop XBO's price $100 after the console launched.
 
They have twice as many players due to the quality of exclusives which by proxy reinforces the consumer to spend more money on said platform, like CoD. By removing one of if not the largest 3rd party game releases every single year and making it exclusive to ANY console, it's removing a huge revenue stream from everyone else.

As MS has said the studios remain independent- Sony and MS could clearly have NDA's between these studios.

The judge seems more into the FTC's answers on the cloud SLC concerns.

The FTC should've at least tied in MS's cloud and services advantages to leverage console SLC strategies from the get-go, and then show how that would have affected customers of Sony platforms in ways outside of Sony's control.

They're doing all 3 angles so they went through them 1 by 1.

Next will probably be cloud as well.
