yes
but they can just negotiate a higher price without walking out
What would that do, though? Shareholders already approved a price. Also wouldn't changing the price change the deal? I think it's a bit more about gaining power and leverage. Bobby's probably asking Nutella to make him an executive.

On July 18, 2023, Activision Blizzard and Microsoft entered into an agreement waiving certain rights to terminate the merger agreement if the merger
has not been consummated prior to October 18, 2023. The terms of the agreement include an increase in the termination fee payable to Activision
Blizzard from $3.0 billion to $3.5 billion if the transaction is terminated after August 29, 2023, and to $4.5 billion if the transaction is terminated after
September 15, 2023
. The agreement also includes amendments to Activision Blizzard's commercial Xbox arrangements with Microsoft, valued at up
to $250 million for each of fiscal years 2023 and 2024. The agreement further enables Activision Blizzard to declare and pay one regular cash dividend
for fiscal year 2023 of up to $0.99 per share, prior to and not contingent on the closing of the transaction. Please refer to our Current Report on Form
8-K filed on July 19, 2023 for further detail.

Yep there's the dividend as predicted:

Yep. Any extra time that their money has to be tied up in all of this while the stock has a glass ceiling is not a positive thing.

Sometimes when situations like this happen (an extension) the company will offer a special dividend to keep people satisfied and invested in the stock while things are still being sorted out.

Oh boy... Here comes the herd of shills that only post in this thread when something happens to pat each others on the back..

My man, this is a hilarious thing to say in light of your posts in the last couple of pages.

Relax. Don't start pointing fingers at others.

Nothing happened because it's done. This is why MS worked out a backroom deal with the CMA, because they were out of time and couldn't start from scratch again. They needed to be able to assure Activision that this is done. Whatever MS and CMA discussed seemingly assured them. I don't have access to secret documents saying this, but we all saw the CMA tweet out 1 hour after the FTC and we all saw how the CMA acted in court. That's the only reason nothing has happened. It's over. They are going to let CMA work through their last few weeks of procedure and then finish it, and that way the CMA doesn't lose face, and MS doesn't have to deal with consequences of more aggressive actions. MS didn't tell me anything to believe; the CMA did, in front of a CAT judge while being grilled on it.
That situation is no longer possible after the 17th's CMA at the CAT. The judge has instructed the CMA to evidence that it meets the necessary test, and only if it meets his the test in his opinion can the CMA continue down that path..

This also confirms the FTC were categorically stupid in bringing forward their PI considering they were scheduled to start the court process in August.

Is it actually confirmed to be that?

Yep $0.99 per share.

It also seems like Bobby has put them on a clock, the breakup fee increases in increments towards October. 29th August is now the first deadline to look out for since that's when the first increase to $3.5 billion comes into effect.

No way they accepted that

There will be some disgruntled shareholders for sure.

He's running out of patience but doesn't want to ruin the deal while it still has a chance.

Very sharp of him imo.

They got played again by believing rumors. Hell MS/AB walked into court and kept preaching how the 18th was killer.
