Yeah, he's not presenting the whole case. The reason all these unions say they will decertify isn't because it's just a negotiating tactic. It's because they're negotiating with a monopoly.
Honest question: Did Fehr ever threaten decertification with the MLB? There it would make less sense because they have a statutory antitrust exemption.

Seriously, I'm ok with it in this instance, a monopoly makes for a more consistent and interesting competitive sports league, but that comes with certain caveats when it comes to dictating costs.
They can play in the KHL or in Europe, not a monopoly.

You mean the leagues that the NHL has non-compete agreements with?
The NHL engages in quite a few practices that would be immediately prosecuted in other industries.
Also, it can be a North American monopoly. A monopoly can exist within one market even if other markets have products that would be competitors if they were there.

I agree with everything you just said. But no one seems willing to say that they believe that the Thursday deadline is as final and absolute as we're being told. There's no point in having a season that is the same length as the playoffs and you also can't have a 48-50 game schedule with full playoffs starting in March. At that point you're fucking up all the offseason things as well as cutting down a good chunk of the time off between seasons.

That's what happened in 2005. Bettman set a deadline, proposals went back and forth, deadline passed, more proposals went back and forth, after a couple days and no progress, the season was cancelled.
