Nintendo has filed a lawsuit against accessory manufacturer Genki for showing off 3D-printed mockups of the Nintendo Switch 2 ahead of its official announcement.

Nintendo is taking the Genki parent company Human Things to court in California over trademark infringement, unfair competition, and false advertising for its conduct around the Nintendo Switch 2 earlier this year.

If found in Nintendo's favour, the suit requires Genki to destroy all products related to Nintendo Switch and Nintendo Switch 2, and to cease using Nintendo's trademarks again.

Nintendo is also seeking to recover "all damages it has sustained as a result of Defendant's infringement, unfair competition, and false advertising, and that said damages be trebled."

Nintendo's suit lays out what it calls a "timeline of Genki's wrongdoing," which began in December 2024 when the company publicly tweeted in response to GameStop CEO Ryan Cohen to discuss "the launch switch 2 accessories [Genki was] working on."

Nintendo keeps on being assholes as usual. What are actual damages to Nintendo from confirmation of Switch 2 being a thing… which everyone and their dog knew already.
 
What exactly did they do? If they signed an NDA with Nintendo to get early information about the console to make their accessories then too fucken bad, and the exact same to Nintendo if they did not.
 
Genki sure as shit poked the bear on this. This whole thing is kind of weird, though. Is Genki saying they didn't sign an NDA? If they made products for the Switch 1, they 100% signed an NDA, or a contract that had a non-disclosure provision in it. They could avoid liability if they didn't get information on the Switch 2 from Nintendo and just sorta guessed that it would be a rehash and made a mock-up based on that. But why do that, really?

Too many facts I don't have, but I don't think it was smart for Genki to conduct themselves this way.

Their reveal video could have had more clicks without the leak.
 
Nintendo just comes off as incredibly petty right now with their lawsuits left and right, copyright strike om YouTubers and their handling of the Switch 2 in general. Take a fucking chill pill.
 
Next time make a less predictable console maybe ? And accessories manufacturers won't be able to guess and 3D print the next console lol.

not every third party accessory manufacturer signs NDAs. Dbrand for example didn't either.

if they got the dimensions and made accessories based on them, without signing anything, they didn't do anything wrong
 
Genki says they never signed an NDA.
If they never signed anything then it's different but if they did and they decided to break it with Nintendo of all people then that's on them.

Maybe it's just me but Nintendo would be the last person I would ever fuck with in the industry.
 
You would think that after 10 years of Nintendo going after random kids named Mario people would have learned not to mess with their intelectual properties.

Yeah....if they broke an NDA then that is incredibly stupid and they will have their ass handed to them. I kind of doubt they are that stupid though. Looks to me like Genki is trying to be something like a dbrand that mocks other companies for the notoriety.

Well, they had It coming, they did leak the console ahead of time. And for what? Nobody cares about their accesories, they're bor any different than what anyone else may produce.
