What partnership? Genki didn't have an NDA (according to them), took a few guesses and maybe insider info and 3D printed the console. And as to the name, yeah, that was tough to guess for sure… 🤡

the Switch 2's entire design schematics leaked, Genki used them to demonstrate their peripherals.

at the time Genki showed their stuff the entire system was basically already public knowledge.
hell we knew the exact SoC since 2023.
the first factory prototype images leaked 8 months ago and were all 100% on point.

Nintendo are more worried about suing everyone including people playing Nintendo roms while taking a shit in the bathroom then they're actually improving the quality of there games. That new donkey kong game they're making has an artstyle that looks like vomit with dark contrasts and colors everywhere. Horrific. And how about giving an adventure mode/story mode to mario kart world, you know something diddy kong racing did back on the n64 which resulted in that game clowing on mario kart 64.
Wait, MK World has no adventure mode? What's the purpose of the open-world then? Why is the game even $80?

I think a big issue to be careful about is beyond Nintendo's listed legal justifications(likely in the right) and that is Nintendo's control of information over consumer transparency. Of course the question is are they doing that here or with any information.

I'm almost positive that all you can do in that giant open world is take photos with friends and complete easy challenges that are insanely simple to beat. They showed off some of it in that mario kart world direct and it looked insanely easy and insanely boring and besides doing those 2 things there's absolutely nothing in the open world. There's no story mode/adventure mode at all like diddy kong racing.

Genki sure as shit poked the bear on this. This whole thing is kind of weird, though. Is Genki saying they didn't sign an NDA? If they made products for the Switch 1, they 100% signed an NDA, or a contract that had a non-disclosure provision in it. They could avoid liability if they didn't get information on the Switch 2 from Nintendo and just sorta guessed that it would be a rehash and made a mock-up based on that. But why do that, really?

Too many facts I don't have, but I don't think it was smart for Genki to conduct themselves this way.
NDAs are limited in scope, otherwise nintendo or any other company would just make you sign a perpetual one and never had to do it again

Unless Nintendo did some major screw up with their NDA's (which Genki say they never signed anyway iirc) this is definitely on Genki.

If they didn't get the info from Nintendo and signed a NDA, they've got it from somewhere else.

Of course revealing another company's secrets will get you into legal trouble. Anyone thinking Sony/MS wouldn't be doing the same if Genki revealed every design feature of the Ps6 and NextBox at public trade shows before any official reveal are kidding themselves.

Why do we always seem to focus on the reasons why Nintendo should not sue people/companies. Rather than suggesting that those said people/companies would not be getting into trouble in the first place if they did not seek attention. This seems like a stupid move from Genki to be honest.

Leaking something you're not supposed to should result in consequences. Actions in general have consequences.
Worse than that for them, they didn't leak anything, they made up false information while using Nintendo's branding.

54. Genki has used Nintendo's trademarks and trade dress in connection with the marketing of its business and its unauthorized third-party accessories, in violation of Nintendo's rights in those marks.

Genki decided to push on Nintendo, they knew there would likely be repucussions but chose to try to get an advantage over their competitors. Honestly I think it does harm Nintendo. A little bit. It's Nintendo's right to protect their products. Couldn't see Valve doing this though.

Genki messed up big time. You don't make a huge corporation like Nintendo angry like that by previewing their new console without their approval. Even if they didn't sign any NDA's they're now going to be drowned in legal costs.

They took advantage of it. I think Nintendo is probably gonna win. Maybe there would be no lawsuit if Genki had not taken advantage.

taking advantage of case dimensions to build stuff that clips onto these dimensions is not violating anything. this is a frivolous lawsuit that Nintendo tries to win by brute force aka. expensive lawyers.

As much as I dislike Microsoft and the xbox brand, Nintendo has become the number 1 asshole company.

At this point I rather buy the next xbox than this outdated hardware.

And we can't take any of this at face value. These are claims being put forth by Nintendo's lawyers. This is not objective truth, by any stretch.

These are corporate assets being stolen and used without authorization, that's like saying emulators developed with stolen official devkits should be legal, or the recently stopped Wii homebrew channel lol.

I mean, one thing is to do a couple memes or fanarts and post it on the internet and other completely different is using leaked model to have illegitimate advantage over competition even sabotaging marketing campaign, they just fucked around themselves like they can't fake being surprised.

I had forgotten what happened with the leaked files, 3D print, and total lack of any relationship or NDA. Thread was basically broken without the refresher course added.

On the one hand, they never signed an NDA. On the other hand, they were never given anything to begin with, using leaked files, and making an entire plastic 3D copy from the schematics and physically transporting it to an event is an extreme degree of premeditated intent to reveal the leaked, stolen, unrevealed data through substantial effort...that might not fly as well, than if they had just posted an oopsie photo or email...
