Nintendo is suing the accessory manufacturer that showed off Switch 2 early

Nintendo are more worried about suing everyone including people playing Nintendo roms while taking a shit in the bathroom then they're actually improving the quality of there games. That new donkey kong game they're making has an artstyle that looks like vomit with dark contrasts and colors everywhere. Horrific. And how about giving an adventure mode/story mode to mario kart world, you know something diddy kong racing did back on the n64 which resulted in that game clowing on mario kart 64.

Well, it proves you can be wrong.

Seems petty but Genki let the cat out of the bag, and marketeers really, really don't like that when it comes to major announcements. Also potentially hurt Switch 1 sales before Nintendo's bean counters could adjust. Stock market is no joke.

I feel taking such actions prevents others from doing similar things in the future.

Also this.

Genki even if they win they lose after all the lawyers fees.

Depends on how much publicity they get due to the lawsuit. This kind of thing has worked in dbrands favor in the past. If Genki is smart they will make a spectacle out of it.

Pretty easy when they only sue those who don't have the resources to fight back.
That's basically every lawsuit ever though.

"A person I know" got sued by "a company located in Bethesda Maryland" for 1.2 million USD due to a 3rd party delay in releasing a set of tools required to complete one of their titles.

Completely out of the hands of "the person I know" but got steam rolled anyway.

Notice how they don't go after big boys for "intellectual rights" like they do little guys. Some of the very lawsuits they go after little guys with in that instance, applies to big dogs as well. But they don't want that fight and case law established when they lose.

I get it, but Nintendo is notorious with this stuff. There is no other video game company that is talked about as much Nintendo when it comes to lawsuits. It is just a part of who they are.

I'd love to see them go after a Sony or Microsoft or someone who can actually punch back. This one is going to end like all the others, more than likely. We will see folks throwing a parade. sigh

Yeah, I agree. With those interactions being so public that impression is justified.

I can understand why people are angry when the "little folks" (that work on projects using Nintendo property) get take down notices or lawsuits threats etc. those folks are just passionate about the property and want to create something with it.

In this case (pun intended) Genki isn't a "little company" and they have access to privileged information. They should respect their position and comport themselves accordingly.

Genki used the exposure from those tweets to advertise their products.

Most likely, this company was under a non-disclosure agreement to not disclose Switch 2 information, and they violated that NDA by revealing Nintendo's product designs early. When you break a contract like that, you usually get sued.

You make some good points, counselor.

I remember back in October every insider were saying switch 2 started mass production, which would inevitably lead to leaks. Nintendo remained silence anyway and guess what? It fucking leaked!

The level of incompetence and now bittery is a clear signal this company is now lead by a lawyer instead of a game developer.

I see the connection now between the skyrocketing game pricing of Nintendo products and these lawsuits. Gotta make up for all that lawyer money.

They said they were not. Doesn't look like Nintendo is claiming they were.

In that case, this one is on Nintendo I feel like. If they're giving out something like high-res renders and product dimensions to an accessory company, and those aren't accompanied by an NDA, I don't know why they were surprised they were shown to the public.

Nintendo keeps on being assholes as usual. What are actual damages to Nintendo from confirmation of Switch 2 being a thing… which everyone and their dog knew already.
I'd counter sue them as I feel it generated hype for the console so free marketing!

I get the blackmarket buying & image use violations but Genki made what maybe a couple grand? Nintendo is just being predatory here & probably just mad they didn't get to show it off on their terms.

I wonder if Nintendo was forced into that January reveal trailer by Genki. It was odd they had that trailer 2.5 months before the April direct.

Genki still crowdfunds a lot of their new products so I'm not sure how deep their pockets are. Hopefully deep enough that I don't lose the money I already paid for the last project from them I backed. They make some pretty good stuff.

I guess they could play victim. But they did leak ip. Which is bad. Especially if Nintendo gave them access so they would know what to make.

Lol… Dude, the real world is not Neogaf 🤣🤣🤣 For god sake 😂

People will shit on Nintendo for this but ultimately it's on Genki.
No. Nintendo could have let it go because there were leaks out there already. They are skapegoating someone that could have legitimately been like, cats out of the bag so I'm going to show my stuff. They already have their 80 dollar PS4 games and fucking 95 dollar drift prone joycons they don't need to be extra cunty.

I would say that their behavior might actually attract hackers. I still think they locked the Switch2 down very tight, but their behavior is motivation for some hacker types.

Genki was in the wrong. Advertising Switch 2 Accessories BEFORE Nintendo actually even unveiled or launched the console in stores.

You don't show your wares for a partner before said partner is ready. Especially not to potential competitors.

As mentioned, it's mostly about precedent. If you knowing let stuff like this slide, then subsequent infringement cases have a stronger defence.

DBrand know where the line is. They get very close at times, but know not to cross it. And mocking a product is fine.

Beyond the legal aspects, Genki is definitely being a dick here. Not their place to reveal Nintendo's stuff. Doesn't make it illegal, but still dickish moves for sure. Ultimately, the line is where ever the courts say it is. Question is whether Genki has the balls to go toe to toe with Nintendo on this. Even dbrand knows when to back down as they did with Sony.

What do you expect them to do? Invite them over and have a tea party?

Genki stepped in doodoo. They have to be held accountable. That goes for any partnership, no matter the size.
