I feel sorry for the guys who put all their effort in to make a game only for it to get shut down but there really isn't a right or wrong here. Well legally there is a right but I know many of us don't care about the legal side as Nintendo could allow it if they wanted to.

Indeed. Rom-hacks are just lines of code. They don't contain any assets themselves, aside from originally-generated ones. All of the code from the original base game is in the ROM of the original game itself, which requires having bought a copy of the game in order to obtain (yeah, yeah, piracy but it's wrong to assume someone's a pirate just because they have a ROM of the game when that can also be obtained through legitimate means and also piracy will exist regardless and has nothing to do with ROM-hacks specifically).

That being the case, under the logic that a ROM-hack, which requires having bought the original game in order to play to begin with, is somehow infringing on copyright, then so is all fanart or fanfiction or what-have-you of Pokemon due to using assets without permission and causing "confusion" as to what is and is not official art. Unless we really want to go down that hole, that shouldn't be something that's encouraged.

This really is the answer, if you want your project to stay afloat then by inspired by Nintendo's IPs, it's clear they won't let you out right use them.
 
Just take down all your facebook pages and trailers. When it gets this high profile they have to make a show to protect their IP. It's fucked up and they're total dickholes for doing it, but just play their game. Finish your little hack and leak the ips patch. They won't do shit. You don't see them coming after RHDN, lord knows how many Pokemon hacks are available there.

I think there's a 2014 demo out there, but that'd be pretty barebones since a ton of the work on the game has been done just this year. There are other near-complete builds which a few people not part of the dev team have, but I doubt they'd leak this quickly.

Cruel, especially this close to release and after all the work is done. I hate Nintendo for doing shit like this, as if anyone who's interested would skip Sun/Moon for a GBC rom hack.
Hope it gets "leaked".
 
Wonder how you can invest 8 years of your time working on something that you know might not even be released because of copyright pressure from the original developers/publishers/whatever.
 
I'll never understand why people think they can use properties they don't own for their own projects. Like it sucks that things like this and Pokemon Uranium get shut down but I really don't pity the creators that much. Maybe it's because I work in an industry that requires working carefully under copyright laws but this level of disregard for commonsense copyright regulations is facepalm territory.

Interesting.... That's another reason shutting this stuff down bothers me actually, that I hadn't really given much thought to before: it puts the fans at risk. Fans are going to seek this stuff out regardless. That can't be stopped, no matter how much companies like TPCi and Nintendo might like it to. However, forcing it deeper underground means the fans who are searching for stuff like this are easier to take advantage of it, because it's harder to talk about yourself being the "official developers" or whatever of the ROM-hack, since that kind of talk makes it more likely for you to get shut down. Thus, it's easier for people to disguise viruses and malware as ROM-hack links since they can't be talked about as openly, which definitely isn't a good thing at all.

ROM-hacks are going to get developed regardless and they're going to be released in some form or another and seeked out and played regardless of what is done. But the more Nintendo forces developers to stay on the down-low, the easier it is for malicious actors to take advantage of that, because staying on the down-low blurs the line between malicious actors and legitimate fans just trying to have fun and show their love of the series in their own way, with the methods they have to set themselves apart and make it clear that there's nothing shady going on and it's a real thing being the exact same type of thing that risk getting them shut-down.

So yeah, thinking about it like that, in combination with the whole hurting Nintendo's profits or whatever and brand recognition stuff being tenuous excuses with the history of Pokemon ROM-hacks, I can't really be on Nintendo's side here.

So unless I'm missing something, this cease and desist was almost entirely because they used Pokemon in the name of their mod?

This wasn't going to be a standalone product like Pokemon Uranium, just a full conversion mod distributed as a patch. Project M was distributed this way, and even though Nintendo definitely had a hand in shutting it down, it never received a C&D.
 
Can't understand the upset around this. Trademark infringement is a thing and I'm sure The Pokémon Company was afraid of confusing the market after that video got so many views.

If you absolutely must release your fangame and refuse to go down the Freedom Planet route then don't say anything until the game is out. You're only putting a target on yourself.

Generally rom hacks have been fine. Super popular rom hacks, namely Sacred Gold/Storm Silver and Blaze Black/Volt White 1 and 2, never got shut down, and they were very commonly recommended for a difficult buff.

Prism seems more ambitious than those though, and maybe Nintendo realized they need to defend their IP more. Hard to say

I wonder at what point these Nintendo superfans will learn to stop doing this. But hey it's your 8 years of life, who is anyone to tell you how to spend it.

The thing I do respect is these people rarely whine or try to get sympathy. They seem to understand why it's done and accept it.

Hopefully what he did have is enough to land him a job working at Nintendo or something.
 
Couldn't they change the name and character art and release is as a legitimate game? That seems much easier than this grey area business.

Of course, the logic doesn't really make sense. If any fangame/fan-product is likely to be doing them harm right now, it's Pokemon Showdown, due to losing sales from people only interested in playing the games competitively and giving them an option to do that that doesn't involve actually buying any of the actual products whatsoever. But for whatever reason, Nintendo, TPCi, and Game Freak seem to have been alright with stuff like that, Shoddy battle, and NetBattle over the years and if those apparently aren't actually hurting their bottom line or whatever based on their inaction despite directly allowing players to very easily play Pokemon battles with other people online, with actual assets from the game and all, it makes any arguments against this game rather tenuous regardless of how ambitious it might be.

Though if they have indeed decided to come for stuff like this I wonder if it's only a matter of time until they turn their sights to battle simulators like Showdown after all...
 
At this point, making anything related to Nintendo is destinied for failure. They don't want a fan community producing interesting original content.

There are plenty of fan games that are fine and untouched. Anyone who thinks they can advertise these hacks on mainstream gaming media and not pay any consequences are delusional. These things stay underground for a reason, and hoping for everyone to be Sega about it is wishful thinking
