This is why I hate when people start talking about the sentencing guidelines. The average kid on this forum has no idea what it actually means so we get people thinking he's literally going to get 7 years for taunting a police K-9.

HE IS NOT GOING TO GO TO PRISON FOR 7 YEARS.

No way he gets more than a fine, but the law still sounds crazy having a 7 year prison stint as any kind of option for taunting a police officer.

As dangerous as the situation may have became, no one got hurt in the end. There should be no jail time here, only a warning or a fine. Brutal legal system you guys have there..

I mean working dogs for sight-impaired people need to deal with WAY more shit than that.

Taunting a dog should inherently be worse than taunting a human. The human should have self-control while the dog will react as it was trained to react to aggressive behavior.

Jail time is obviously still absurd in this case, but this should definitely be a crime.

Just fine him and move on.
Fines should be proportionned to the income of the offender

fining a person who does minimum wage is more devastating than giving out the same fine to a millionaire

Well if he goes to jail for 7 years, there will be tons of protests and that law will be changed. I can almost guarantee that.

But I doubt very much he even goes to jail at all.

Unless the judge has a bad day and decides he doesn't like the defendant.

The police dog is trained to attack people (assist dogs are trained to ignore people). The attack is actually his reward, and police often allow the attack even when a suspect is under control, otherwise the dog's training is compromised.

well.. the 2nd part of that statement is totally fucked up, if true.

but my understanding is that the dogs are trained to do a number of things, subduing being one of them, by latching onto the arm and distracting a suspect.

So police k9s have the same amount of restraint as their human counterparts.

This is ridiculous. They are basically admitting to having a dangerous weapon they can barely control around the general public.

Wow. Really? I bark back at dogs all the time. I don't mean to but it's like a knee jerk reaction. This is just silly overreaction.

Now if the dog could tell he did something wrong and was justified in its barking then they have something. But just barking back at a dog is a stupid thing to be convicted for.

What?? That dog is a dangerous animal trained to track and disable at a moment's notice, and it's more or less police equipment. This immature dick made a dog wild with rage, making the police officers have to spend time and energy to calm the dog down. Taunting a dog isn't the issue here, in a way it was taunting the police officers and disrupting their jobs basically. I don't think this guy should get prison time but he does have to seriously smarten up, it was just a dumb thing to do.

He was interfering with security, and safety. A fine sound perfectly reasonable if he really was taunting the police dog as the article says.

The maximum sentence is what they hang over your head to force compliance in whatever sort of punishment they want to issue in lieu of the max, so its still relevant. Maybe not so much for a rich person that can afford a proper defense but say Joe schmo was hit with the same charge. The DA offers a month in jail, or a week... Or even a day. Poor Joe jumps at it because hell a month is better than 7 years even though for something like this even a day is too much.

Does anyone think this guy was actually taunting the dog? He most likely came out of the locker room, hyped up with his teammates, saw a dog, probably spent 3 seconds making a barking noise, and walked away. There's no way that's what the law is trying to prevent. Guess we'll just have to wait and see the video.

It doesn't. he just doesn't know what he's talking about. You can call a cop a fat pig. Fighting words are a very specific thing that basically mean words that would immediately cause a person to lose rational thought and react violently. Like calling someone the n word. Calling a cop a fat pig would never ever be considered fighting words by any court in 2015.

They could most likely arrest you on disturbing the peace though. But even that would be just to make your life miserable by making you pay an attorney to get the charge dropped.

The First Amendment does not protect obscenity, child pornography, true threats, fighting words, incitement to imminent lawless action, criminal solicitation or defamation.
